How to get a Swedish Resident Card (Uppehållskort) through Marriage

I applied for and obtained a residence permit as a non-EU citizen married to an EU citizen who registered her right to reside in Sweden. This procedure is essentially the same for any non-EU citizen applying to live in Sweden through marriage to an EU citizen (and a similar process for marriage to a Swedish citizen, however Swedish citizens cannot bring their spouses to Sweden immediately). I was living in Sweden from start to finish when I applied and it took about six months until I received a residence permit that was valid for five years. It is possible for Migrationsverket – the government agency in charge of issuing residence cards – to issue a residence permit, known in Swedish as an uppehållskort, sooner, and in some cases this process does not cost anything. And remember that the initial residence permit is not a permanent residence permit- you can apply for this after you have been in the country five years.

The process for obtaining a residence card or Uppehållskort in Sweden through marriage or a civil partnership can be completed in the following steps:

  1. Meeting spouse / common law partner / registered partner prerequisites

  2. Application to Migrationsverket

  3. Biometric and photograph appointment

  4. Additional Information

Step 1. Spouse Requirements for you to Apply for an Uppehållskort

As you are a non-Swede and member of a non-European Union country, your spouse must meet certain obligations to sponsor you, and your children if you have any.

First, the sponsoring spouse must have the right of residence in Sweden if he or she is not a native Swedish national or permanent resident. All EU/EEA-member country citizens have this right, as does anyone with a valid residence permit.

As a non-EU citizen you are also subject to the maintenance requirement. Recent changes in the law mean that EU citizens are also subject to the maintenance requirement. This requirement includes:

  • Proof of employment or capacity to provide financial support

  • A home with at least a kitchen or kitchenette, a living room and bedroom for two people, and one additional bedroom for additional children, with two children being able to share one room. The home can be sub-rented with approval of the landlord

A note about the maintenance requirement- non-EU citizens must be able to provide for themselves, even if they are married to an EU/EEA citizen (excluding marriage to Swedish citizens), however Migrationsverket will take the income of both people into consideration for this.

If your spouse or partner is Swedish or a permanent resident, he or she will simply need to obtain a family status report/civic registration (Familjebevis för uppehållstillstånd) from the Swedish Tax Agency (Skatteverket).

Step 2. Applying with Migrationsverket

Once you have reached this step you and your spouse can begin collecting all the papers you will need for your application. You can apply online or print off the following applications and mail it in. Online you have two choices for an application route:

  • Application for a residence permit to join your spouse or common-law partner (already married or have cohabited abroad)

  • Application for a residence permit to come to Sweden and marry/cohabit with your spouse/common law partner (not yet married or have no prior history of cohabitation)

You will also be wondering if you can apply when you are already in Sweden. Here are the rules for that:

  • If your spouse or partner (you are already married or you have lived together abroad) is Swedish or a permanent resident you will need to apply through the Swedish embassy in your home country and wait until you receive a residence permit

  • If you are already married or have lived together and your spouse/partner is an EU citizen (not counting Swedes or permanent residents) you can apply for a residence permit after you have arrived in Sweden (for instance, you arrive in Sweden as a tourist and then apply) — **Note for people in this situation: I wrote this in 2012, and as of 2016 it seems this process may have changed that the couple first register with Skatteverket (the Swedish tax agency) and then apply for the residence permit with Migrationsverket. I haven’t had anyone write who successfully completed the process in this way yet, but here are two points of relevant discussion (point 1, point 2)

  • If you are not married and have not previously lived together and wish to become married or cohabit with someone in Sweden you must apply and obtain a residence permit before you enter Sweden

And there is also a gray area. What if you want to marry a Swede, apply in your home country, and then travel to Sweden on a tourist visa, returning to your home country before your visa expires? What if you come to Sweden on a tourist visa and decide to get married all of a sudden? These are the types of questions are answered in the forum section below.

Required Documents to Submit with Your Application

Whether you apply online or by mail, you will need to include certain documents with your application, and these must be in either Swedish or English:

  • Main application for Residence Permit form 161011

  • If you are moving as a spouse/partner to a non-Swede, non-permanent resident who is from an EU country and registered in Sweden, use form 145011

  • Family Details form 239011

  • Copy of passport pages showing your name and expiration date

  • If you are moving to a Swede or permanent resident, the person you are moving to must obtain a family status report (Familjebevis för uppehållstillstånd) from the Swedish Tax Agency (Skatteverket). This is a type of civic registration certificate

  • If you are moving to a non-Swede, EU state member spouse/partner then submit a marriage certificate or documents showing you have lived together

  • If you have a child under 18, use form 163011
  • Fees: SEK 1,500 for adults and SEK 750 for each child. Exemptions to the fees apply to the following:

    • If you are from Switzerland or Japan

    • If you are moving as a spouse/partner…

      • to a person designated as being in need of protection

      • to a person who is from another EU member state and has registered their right of residence in Sweden

Note that there are additional forms for people applying to Swedish missions in the United States, Russia, Serbia, India and Switzerland. These, along with all other applications and questionnaires, can be found on Migrationsverket’s forms page. You may also need to include additional information as specified in your application, such as bank account statements, proof of health insurance, etc.

Step 3. Biometric and Photograph Appointment

Regardless of your application path for a residence permit, before you get this you will need to be photographed and fingerprinted. If you are abroad and notified by mail that you are qualified to obtain a residence permit you may enter Sweden by presenting this notification and your valid passport if you do not need an additional visa. Once you are in Sweden (and if you have been there all along and receive this notification) you will need to make an appointment to get your fingerprints and photograph taken.

If you need a visa to enter Sweden you should contact your country’s Swedish embassy where you can be photographed and fingerprinted. They will mail your residence permit once it is ready.

In my case Migrationsverket lost the photographs they took of me at their main office in Solna and I only discovered this after my residence permit was late in arriving by two weeks, and then only after I called them to ask if there were any problems. That also meant waiting another two weeks for the next available appointment, so make sure to monitor this process and mark the dates on your calendar.

Step 4. Additional Information

Waiting Times

I applied for my residence permit within Sweden as a non-EU member moving to an EU member registered in Sweden whom I had married abroad. It took about six months before the permit came in the mail, and that is including one month that got burned because my photographs were lost. It is prominently advertised that if you apply online your wait time will be significantly less. Migrationsverket writes on its wait time webpage that paper applications are processed in 14 months and online applications take 10 months.

When you Arrive

Make sure to bring the following documents with you when you come to Sweden:

  • Marriage certificate or proof of union and if possible, proof that the marriage is registered in the arriving spouse/partner’s home country

  • If you are coming as a co-habitee, bring a lease or apartment rental contract showing you have lived together before

  • If bringing children, bring their birth certificates

  • Any other documents showing that the person you are moving to is emotionally and personally close to you and that you strongly want to live together

  • Proof of health insurance, if any

  • Bank account statements

Taking the Next Steps

Once you have your residence card you can breath a sigh of relief, but you still cannot yet work legally. To do this you will need to apply with the Swedish Tax Authority, also known as Skatteverket. This agency is completely separate from Migrationsverket, and an application for your personal number (personnummer) that allows you to work involves many of the same documents you will have submitted for your residence permit.

Please note that I’m just an average person who got a residence permit in Sweden. Perhaps I can offer useful suggestions for you if you are in a very similar situation as myself. Otherwise, I really can’t provide you with any better information than what you would find on the Migrationsverket website.

If you have questions about immigrating to Sweden that aren’t based on my own situation (and even if you do), please check through the following links and comment directory. Feel free to ask any question, as I hope someone out there who was in a similar situation might be reading and leave you a relevant answer. I’ll periodically organize questions and sort them by category, however I can’t guarantee a response.

Most important of all, I would encourage anyone who asks a question to post back later with details about how their situation turns out. This is where we can all get the most valuable details.

hello I just want to ask about the health insurance.. I just recently got my residence card and my husband wanted me to move to Sweden by the end of the month. I just wondering what type of insurance do I need to provide? thanks

Congratulations on the residence card. You must be asking about long-term insurance while you are there, because you had to show proof of current health insurance that was valid in Sweden when you applied for the residence permit, correct?
To get into the Swedish healthcare system you need to get a personal number through the Swedish Tax Authority (Skatteverket). The most common way of doing this is by finding someone in Sweden who will make you a job offer. You are eligible for the same health insurance as Swedes once you have a personal number. Emergency medical coverage for you starts as soon as you make an application with the Skatteverket for a personal number.
When it comes to applying for a residence card or renewing a residence card, you need to have health insurance that will cover any costs that might be incurred in an emergency. This means insurance coverage with a maximum limit of at least 30,000€ (~246500 SEK).
      Hope this helps, good luck

Hi, I am an American citizen marrying a Swedish Citizen and we are currently living together in Sweden. I am on a temporary visitor’s permit which expires 28 February 2015. (No I didn’t apply for residency before moving here, we previously lived in China and if you think Sweden is bureaucratic hell then you haven’t been to China) Is it possible to gain a residency permit while I am here, or do I have to go back to the US? Or can I apply at a Swedish embassy in another country (we live very close to Copenhagen) and wait for it here in Sweden? Or can I apply online now, then go to the US to get the actual permit? Basically I am attempting to not have to leave for any real length of time, I’ve been offered an unpaid internship beginning mid January and having to wait in the US for a permit would make me sacrifice the position.

Congratulations on your upcoming marriage- according to the official material from Migrationsverket you can only apply to live in Sweden with a spouse, common-law partner, or future spouse or common-law partner, if you are currently residing in your home country.

You’ve probably already looked at the relevant pages from Migrationsverket, however this doesn’t address your specific situation that you are already living legally in Sweden.

I was in a similar situation as you and I was permitted to apply for my residence permit while already in Sweden and remain in Sweden while the application was processed (and eventually approved). From this experience it would seem like there is good reason to hope for you. Because your specific in-country situation isn’t addressed on the official material from Migrationsverket, your best option may be to make an appointment with someone in that agency and tell them about your circumstance.

Some back up options could be to talk with the organization that is offering you the internship and see if they know about any way of getting you a work permit as a volunteer so you can stay in Sweden. You could also see about enrolling in a university (some university programs are free to study) and getting a residence card based on the fact that you are a student.

Also keep in mind that ultimately a residence permit based on any of these justifications will require you to show Migrationsverket that you have health insurance and enough money (between the two of you) to support yourself while you are in Sweden — 10,800 SEK per month for two people.

In any case good luck — once you get it figured out feel free to post again with an update. Don’t get discouraged from Migrationverket’s general online material – wait until you speak with someone.

        Hi!

I am in a similar situation but with Sambo Visa. However I have some questions you may know more about.

I am Swedish citizen who moved to New York last august, met an American guy in October, fell in love and now I have to go back to finish my Medical Program that I have 2,5 years left of. Me and my boyfriend have spent every day together since October. Except when he went back to his hometown one week and vacation one week. So we have a really close relationship.

However it feels awful that I may need to leave him when I am goin back in August. I just found out this Sambo Visa and we, of course, applied for it directly. But it says it takes a long time to get the Sambo Visa, like 5 months. My boyfriend apartment lease and job ends in August so it would be the absolute best if he could come with me even if we wait for the decision.

He has applied for jobs but he is a film maker and most jobs in film production business are freelancing and it seems so hard to get work permit for that. However, he has also applied for Eures Jobs as waitress and such because he really wanna live there with me and maybe freelance on the side.

        Sorry for long text.
        I have some questions now:
        1. Can my boyfriend come with me as an tourist to Sweden?
        2. You mentioned free universities for Non-EU citizens. What kind of universities are free, with like basic courses (we will live in Stockholm). He has already a Bachelor Degree from University. (We live in Sweden) to study for and can he apply from Sweden and get Student Visa from here?

        Thank you!

        Best
        Isa

        Hello Isabelle,
I’m afraid I can’t offer you much useful information- I’ve just read the main migrationsverket webpage about “moving to someone in Sweden,” and as far as I see it doesn’t say you can’t be a tourist while you have a pending sambo application, just that you must make your sambo application from outside of Sweden. Maybe the Swedish version has more details?

For your second question, I would also defer to the information you could find in Swedish about the topic of education and student visas. However, to get a resident permit based on being a student, a US citizen would need to be admitted to a full-time university program. I would guess that for most traditional university programs one would need to apply many months in advance to be accepted. However maybe you could find a spot somewhere, pay tuition, and then he could choose whether or not to actually go to classes. This site has some information about student visas: https://studyinsweden.se/how-to-apply/residence-permits-and-visas/

Besides hoping for a quick processing time on the Sambo visa, it sounds like the best option might be a work visa. Maybe he could work out something about being a self-employed film guy? https://www.migrationsverket.se/English/Private-individuals/Working-in-Sweden/Self-employment.html

I wonder if anyone in his situation has ever come to Sweden as a tourist and then applied for asylum? They have a backlog of asylum applications right now, and he can always extend the process by appealing.

        All the best of luck

I am an EU resident (British) and my spouse has just got a job in Sweden, she has applied for her personnummer which is on its way. I can move to Sweden with her and have right of residence (as an EU citizen) but the tax office will not issue me a personnummer without a health certificate from the UK Govt. Unfortunately the UK have decided to stop issuing these due to cost savings so I am stuck in a grey area I can move to Sweden with my spouse but will not be able to get healthcare, insurance (or even an Ikea card!) without the personnummer.
Does anyone know any way around this?

    1. Administrator Post author

      Hello Jen,

Yes you are correct- however you apply for a personnummer (as a spouse/common-law parter/registered partner OR as an EU citizen taking advantage of your right of residence) you will need to show proof of comprehensive health insurance that is valid at least one year.

I found some information about a European Health Insurance Card (EHIC) that is free for UK citizens- maybe this might work. In any case I would contact Skatteverket and tell them about your situation.

When I was applying for my residence card (albeit this is from a different agency Migrationsverket — not Skatteverket) I was supposed to meet this same health insurance requirement. I had private travel insurance from a US company with a coverage limit of ~245000 SEK that cost about 275 SEK per month. That worked on my application, so from that experience it would seem “comprehensive” health insurance is open for interpretation. Good luck!

Last april 2016 i go back to my country and stay there for almost 6 months ang then go back here in sweden but my problem is now that im pregnant that why i need to go back here in sweden to give birth that why im asking if ist possible that i can bring the father of my child here even if im not yet citizen?

        Sincerly Dayan!

      2. Administrator Post author

Hello Dayan, first to confirm: neither you nor your boyfriend are EU/Nordic citizens or permanent residents. In this case I can’t find any information that would allow your boyfriend to come and join you in Sweden. From what I’ve read on Migrationsverket you must be at least a permanent resident of Sweden or a Nordic country. Sorry for the depressing answer, but perhaps I’m missing something and someone from Migrationsverket (or another reader here) could provide you with more optimistic information. Good luck!

I have a study permit here in Sweden, and when I applied for my first permit I didn’t indicate that I am married, now that I want to renew can I use my marriage certificate and also indicate that I am married for renewal,to enable my husband to join me over here.

hello i applied for a resident permit to be with my Swedish partner while in Sweden but we have both lived in another european country before moving back. I got a letter from immigration saying i could be rejected because i am applying while in Sweden and general rule is that i apply from my home country. I was told if i want my case to be processed i should pay the application fee 1500sek and i can call them if i have any questions. I did contacted the migrationsverket permit unit since the letter came from them and i stated the reasons i cant go back at the moment but i was told they will write that down but i have to wait until a case officer is assigned to be. My Swedish partner is 3 months pregnant and i have notified migrationsverket and i was told to send in the pregnancy certificate/ ultrasound as they need to see proof of that and it will be attached to my application. But somehow i still don’t know what the outcome and the decision to my application will be. For now i know i submitted every required documents they asked of me. Wondering if you have any idea on this or if you have witnessed it happen to someone and whether it turned out good or bad for them, Thanks.

Hello Allan- congratulations on your upcoming baby!

Judging from the document through this link (http://www.migrationsverket.se/English/Private-individuals/Protection-and-asylum-in-Sweden/If-you-have-or-are-expecting-children-in-Sweden.html) it looks like you can apply for a residence card while in Sweden if your partner is Swedish or a permanent resident, and/or your child will be a Swedish citizen. Under the heading, “If you have or are expecting children in Sweden”:

“If you are in Sweden without a valid residence permit, you may in certain cases receive a new residence permit without having to leave the country. This applies to anyone who is the parent and guardian of a child who has a residence permit or who is a Swedish citizen, and those who have or are expecting children with a person who is a Swedish citizen or who has a permanent residence permit. You must also live with the child.”

Good luck and feel free to update how it goes for you

Thanks so much for your reply and concern, i got same e-mail from the migrationsverket that i can get permit if i am expecting or have a child with a swedish or someone with a permanent resident in sweden, so right now we are waiting for the form they said my swedish partner will fill and enclose her medical pregnancy proof too. We are both hoping for the best but for now we are waiting and they said the asylum case they have makes things though meaning there are long waiting line and time on applications that we have to have patience. I will keep updating if something new happens.
        Regards,

Hello sir ! I am from Albania we are not in Eu but we can travel in shengen area i am married with woman from eu ,she lives and work in sweden we marry in sweden ,Can You tell me pls what kind of documents i need and how can i apply for swedish residence Thanx

      Hello Rroku!

Your EU-citizen wife living in Sweden will need to take the initiative for applying. She must register that she lives and works in Sweden first, then you can apply. She can find the information she needs on this site.

According to that site, she needs to register with the tax agency Skatteverket.

Once she has registered you can apply for a residence permit through Migrationsverket. The list of documents you will need can be found here.

The application you will need to submit (by mail or in person) to a Migrationsverket Permit Unit Office is Application for Residence Card form 145011, which can be found here:

I was in the same situation as you about three years ago, and from reading Migrationsverket’s website it looks like they have changed their procedure slightly. When I did this the process was: EU-citizen wife registers her residence with Migrationsverket, then I can apply for a residence permit through Migrationsverket. Now it looks like EU citizens do not need to register their residence through Migrationsverket, but instead register to get a tax number through Skatteverket. To be honest the Migrationsverket website is a bit confusing. However in your case – whether your wife needs to register with Migrationsverket or Skatteverket – either way should be just a matter of filling out paperwork. I would think the hardest part of this whole process is you meeting the conditions for a residence permit, but if you are married and your wife is working this should be easy.

Good luck! Feel free to post back later on how it goes

Hi. I am a New Zealand citizen who is married to Danish passport holder. We are planning to move to Sweden. My wife has been offered a job teaching and I will be able to pick up some part time work at the school. We arrived in Europe in the middle of April. My wife will get a tax number as soon as possible so that I can then apply for a residence permit. We plan to travel around Europe for a month or two as my wife’s job will not start until August. My questions are based around timing as my 3 month tourist visa will expire in July. Am I able to stay in Sweden after this date if I have applied for a residence permit? And if so what proof will I then have that I am allowed to be in Sweden? I was also wondering what happens if I need to leave Sweden for a short period of time while I am waiting for my residence permit?
    Thanks, Josh

      Hello again Josh,

I did some more research and found these three sites that may be helpful for you:
      http://www.thelocal.se/discuss/index.php?showtopic=59086
      http://www.expatica.com/nl/visas-and-permits/Dutch-re-entry-visa-for-returning-to-the-Netherlands_108435.html

One of those applies to The Netherlands, but I would guess the idea is the same as they are in the EU and the Schengen Area. Of course take the forums with a grain of salt, and I would say your only certain answer will come from an email or talk with Migrationsverket.

To sum it up, the expatica site says you would need a return visa to come back to The Netherlands if your application for a residence permit is pending when you leave (and later on The Local site someone says that Sweden doesn’t even offer such a thing as a “return visa”).

The thread in The Local forum may be more helpful, and looks like it was started by someone who was in a very similar situation as yourself. According to that forum, one point is that commercial vessels (buses, airplanes, ferries) are not allowed to transport you to Sweden unless you have a valid official document, such as a residence permit. Another point was from someone who said she talked with migrationsverket and was told she could not leave Sweden and return without a valid residence permit or visa. She alluded to someone else who had to remain in Sweden for around a year without leaving who was in the same situation.

So in summary from these sources, it looks like you may actually be facing a long stay in Sweden once your three month visa is up- maybe you could at least extend this.

      Once again, good luck!

        Hi again.

Thanks for your reply. I guess I will just have to see how that one transpires.

I have now applied for my residence permit. I was sent the automatic email saying that it had been received. My wife then had to complete an online form also. As my 3 month tourist visa will expire soon, will I receive anymore solid evidence or official documentation saying that I have applied for a residence permit and that I therefore have the right to remain in Sweden until the decision has been made? I am just a little apprehensive that I will be in Sweden without much proof I can be there.

        Thanks,
        Josh

      2. Administrator Post author

        Hello Josh,
To answer your question, I’m not sure if you will receive anything more than an email confirming you have applied. When I applied about three years ago I had to do it by mail and I also received a letter in the mail about a week after I’d applied that confirmed this.

It’s easy to understand your apprehension. One would assume -and hope- that if you ever got into a situation where you needed to show you had a pending immigration case, the authorities involved would be able to confirm this.

Perhaps this migrationsverket site can reassure you (beginning about halfway down that page) under the heading “If the Swedish Migration Agency refuses your application”

It seems to indicate you can stay in Sweden and appeal your decision (assuming your application is rejected) up to three weeks after you receive this notification (this seems to indicate you would have been in Sweden all along). Logic would stand that if your case is accepted, you would naturally also be entitled to stay in Sweden while this was considered. Once again this raises your original question of showing official proof that you have an outstanding case.

The heading below (“If you are in Sweden and your application if refused”) confuses your situation even more, saying if you are refused you can appeal but, “…you still have to plan to return to your country of origin…” In any case, that still sounds like you would have been able to stay in Sweden while you applied for a residence card. (Thank you migrationsverket for the completely vague phrase “plan to return to your country”)

I’m afraid that soon this response will start to resemble a snake eating its own tail- sorry I can’t say something more clear. Feel free to post back if you find out anything else, or about how your case develops, and once again good luck.

My girlfriend is Swedish and I’m an American, we were hoping to get married around New Years this year.. But after seeing the process, we had a couple questions. What if we were to just get married without applying for the residence visa? If we do get married, how long would it take for me to get a personal number to work? because I know that is with a different agency. I had some friends in the States that just got married and didn’t bother with doing it the proper way.. and the only thing they had to deal with was that the government kept tags on them for about seven years to make sure the marriage is legit. We are sure about marriage and know this is for the rest of our lives and want the rest of our lives to start now.. Would Sweden make me come back to the states if we were already married?

      Hello Jordan,

Congrats on your eventual upcoming wedding. To answer let me clarify that I understand your question: you are wondering about getting married in Sweden, and whether to apply for a residence permit before or after you move to Sweden. If I misinterpreted your question let me know and I’ll repost.

If this is your question, the part about marrying in Sweden is addressed above in the response to Lydia Nicoll. As far as the time it takes to get your personal number (personnummer), once you make a complete application it should take around 1-3 weeks.

      Hope that helps

      Hello Abdi,
If you have a Swedish residence permit (uppehallskort) that is valid longer than your stay in the UK then you can go and visit your family (in any European Union or Schengen Zone country) for up to 90 days. Travel companies may also require that your residence permit and passport are valid for at least 90 days beyond your stay in the foreign country. All you need to travel to any country in the EU is your passport and residence permit.
Thanks for the post and have a good trip!

Greetings Kana and thank you for your post,
The answer to your question is just above in the response to Allan from May 8, 2015. It looks like you may have some work ahead of you 😉

Also keep in mind, since you are married to a Swedish woman you have the right to live and work in Sweden even if you have no kids. You just need to meet the conditions to qualify for a personnummer and Uppehållskort (residence card).

      Good luck!

    Hello!

I am a Canadian citizen, and my sambo is a Swedish citizen, living in Sweden, who has her Canadian permanent residency already. I was wondering what the process would be for me to obtain my personummer once in Sweden? I will not be working as I have been accepted to a masters programm and won’t have the time available with commuting each day. Will this cause issues for me?

She has warned me it is really hard to do much of anything without the number..

I have had my interview with the consulate 12 weeks ago and still haven’t heard anything back. If I do not receive my decision by the beginning of August it will be too late for us. Any idea on timing these days post interview?

    Thanks so much!

      Greetings Scott,
First let me start by dodging your question about the personnummer. You don’t need this to live there- all you need is a residence permit (valid up to five years), and you can apply for this, in your case, based on either of two criteria: 1) as a student studying in Sweden, and 2) as a cohabiting, common-law partner of a Swedish citizen. You can apply for a residence permit as a student after you have arrived in Sweden. In any case, you can always enter Sweden as a Canadian tourist for three months.

To address your question directly, yes, you need a personnummer to do things like get into the Swedish pension system, the healthcare system, take state-sponsored Swedish language integration courses, and of course work. I got as far as getting a library card without a personnummer.

Most recently when I looked into it, the process of getting a personnummer seems to have changed a bit from when I went through with the ordeal, and this is hopefully detailed to your satisfaction on the Personnummer in Sweden page.

      Hopefully that helps!

    Hello,
I am from Malaysia and my boyfriend is a Swede. I applied for my residence permit in December 2014. I have bought flight tickets to visit him in September 2015. Can I visit him while my visa application is being processed? I read a clause in the Migration Board website that one cannot but I am unsure if I misunderstood. I appreciate any kind of information. Thank you.

I am in the exact same situation!! But I am an american citizen. I have a trip planned for October 2015. Please let me know what you ended up doing I would appreciate hearing how it went/goes! And how you notified MV and what happened with your application? I am also curious to know when you will get yours since we applied at the same time!

Hello Janet and thank you for your post,

I think I found the passage you referred to on this migrationsverket link under heading #6: “You may not enter Sweden while your application [for a residence permit] is being considered. Your permit must be ready before you travel to Sweden.”

This would seem to contrast with the notion that as a Malaysian you can visit Sweden for 90 days as a tourist without needing a visa. I’m not sure which has precedent here. Perhaps the best thing to do is contact someone at migrationsverket. Sorry to not have a more definitive answer for you.

Good luck! Feel free to post back with what you learn.

Oh. I must have confused you with me using the word visa. It was a typing error. I meant to write “Can I visit him while my permit is being processed” because of that clause. 🙂

Hello Christi and thank you for your question,

According to the following link from Migrationsverket, it looks like you do have the possibility of getting a residence permit and being able to stay in the country while your case is processed. Check under the heading, “If you have or are expecting children in Sweden.” (http://www.migrationsverket.se/English/Private-individuals/Protection-and-asylum-in-Sweden/If-you-have-or-are-expecting-children-in-Sweden.html)

So the good news is this is a possibility. Really it all depends how your appointment goes with Migrationsverket at the end of this month. This section linked to above says you can stay in Sweden while your case is processed if it is in the best interest of your children.

Good luck! Feel free to write back how it goes or with any other questions.

    Hello.
Please any advice you can give on my situation would be very helpful. I am an Australian citizen who met and fell in love with a Swedish citizen in Australia over 3 years ago. We lived together in Australia for some 14months but we have little proof of cohabitating in Australia as everything was already in my name. Only photos and sworn affadavits from friends and family. She returned to Sweden a little over a year ago without me for family reasons. It took the best part of a year for me to follow but i finally arrived in sweden 4 wks ago on a 90 day stay. Problem is i now want to stay here so we can marry and settle in sweden. You could imagine we don’t want to separate again so the sound of having to return home just to fill out some forms and wait would be a nightmare. Besides i gave up everything in australia to come here my apartment my job and most of my possessions. We did not envisage how hard this could be. I don’t speak swedish so finding a job and obtaining a work permit is proving difficult. And life for me without a personal number will be hard here if i apply for a temp residency permit. We are not sure what to do so any advice you can offer would be great. Thanks PJ

      Greetings PJ,
Thanks for your question- it sounds like you have already read Migrationsverket’s webpage that says you must apply for a residence permit from your home country whether you do so as common-law partners, married partners, or partners who are intending to get married. You probably also read the part that if your partner was pregnant you might be able to stay in Sweden while your residence permit application was processed. Basically these factors make your wish to stay in Sweden longer than 90 days an uphill battle. That’s very frustrating considering all you have gone through to reach this point.

Aside from biting the bullet, spending a fortune on airfare for you and her going back and forth between your respective countries while you wait for your residence permit to be processed, and going through more of a distance relationship, I would say your only other possibilities are finding a job in Sweden and getting a work permit, or enrolling full-time in a university to get a resident card based on being a student. Depending on what your skills and background are, the job might be easier.

Sweden makes a special exception for Australian residents that allows you to apply for a work permit good for one year without having a prior job offer (https://www.migrationsverket.se/info/164_en.html).

You’ve at least got three months to develop your next plan. Best of luck!

      Hi Paul Jones and Administrator,

I am in a similar situation. A swede living with my boyfriend (non EU) in a non EU country. We have a contract proving we have been living together for a year. I am looking for a job in Sweden so i can move there with him, but have been looking onliny, and migrationsverket are more particular about long-distance relationships, and not so much about these cases.

My question to Paul would be, how did you go about this? How long did you wait? Etc.

      To the administrator,

Considering past 2015, the rules have become more strict, I was wondering if anyone has written about a similar issue. Is there any guidance you can give us on this? It seems rather ridiculous that sweden would have their own citizens seperate from their spouses for over a year, while other EU citizens get to move to Sweden fairly quickly. Am i missing something?

    Hey!

I’m a non EU citizen but a permanent resident in Sweden. My girlfriend is albanian and we have a real relationship which started more than a year ago.
My girlfriend was in sweden as an asylum seeker when our relationship started, she got negative decision and she left back to albania
then she applied online for living together to migrationsverket in Dec-2014
now my girlfriend has a meeting in the swedish embassy after a couple of days regarding to our application
Though she has prepared these documents to be with her in the meeting:
    – copies of her passport, ID-card
    – The original flight tickets which proves that she visited me twice
    – Photos for us together and snapshots of many conversations and video calls we had together.
And we want to know what else documents does she need with her?

Ps: I don’t have any work contract and I’m still studying swedish, I get “etablerings” salaries monthly which is around 6500 SEK
though I had a working contract but it was ended in May-2015
I’m afraid about the answer from migrationsverket to our application.
hope I can get some info to help me knowing what to do, though me and my girlfriend are not married and she’s not pregnant.

    Thanks for your answers,
    Regards, Dani.

Greeting Dani and thanks for your question,

It sounds like your partner will be applying for a residence card based on the fact that she is coming to live with you as a spouse or common-law partner. That sounds like a good idea for her to bring those types of things that show you have a relationship (photos, and flight tickets). I can only advise what to bring based on this website: (https://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Planning-to-marry-or-become-the-common-law-spouse/How-to-apply.html) that says to bring original documents that were used on her initial application.

According to this website (https://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse/For-the-relative-in-Sweden/Maintenance-requirement.html) you do not need to meet the maintenance requirement (minimum income and size of home) if you meet conditions, such as having a permanent residence permit and have been living in Sweden for four years.

If you find out any teachable information from her interview feel free to post back. Good luck and hopefully the interview goes well!

    Hello,

I am a non EU citizen but applied for a residence permit last year to join my partner in Sweden. Fortunately last week i was granted a permanent residence permit 🙂 Making me the happiest person because we’ve been apart for almost 3 years.

I am yet to receive a call from the embassy to collect the card which they said it’s been sent from Sweden. The wait is killing me knowing that i have been granted. My only questions are, Is the card valid for travel to Sweden as soon as i am called to pick it up or is there a sort of grace period before i can use the card (i don’t need a visa if i have the card, am i right)? and
Would you by chance have knowledge of the time frame it will take for the card to be sent from Sweden to an African country.

I am a bit confused because of all the plans i’ll have to make within a limited time so any advice you can offer would be great.

    Thank you very much.

      Hello Mari,
A big congratulations to you. I don’t have direct knowledge to answer any of your questions, however the Migrationsverket website has some answers for you.

This first link (https://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Planning-to-marry-or-become-the-common-law-spouse/How-to-apply.html) says to contact the Swedish embassy/consulate in your country to see if you need to schedule a time to pick up your residence permit, or to see if maybe it will be mailed out to you. I would say check once a week with the embassy/consulate- in my experience in Sweden they made a mistake and didn’t realize it for more than a month.

This link (http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse/After-the-decision-has-been-made.html) explains that you might need to wait up to four weeks to receive your permit, from the time you are notified that you will get a residence permit. It also says that while your permit will be created immediately once your decision is made, when it is created it will be for a date that is three months from that time (so it sounds like you might end up waiting the longest three months of your life). If this is the case, maybe you could get a tourist visa first and go there sooner?

The link above also addresses your question about the visa. Did you have your photograph and fingerprints taken for the residence permit you are about to get? If so, it sounds like you will not need a visa and you can show the Swedish border control your residence permit.

Once again congratulations and hopefully you don’t need to wait long!

Hi, I have a situation because I am not married but have a relationship with a Swedish person. I applied in September 2014 almost 11 months ago, I had the interview but haven´t received any further information since April. Anyway, I applied the university in Sweden and have been conditionally admitted.
What should I do, ask for a new residence this time as student or keep waiting?
Everybody is “pa semester” and not answering 😉 any thoughts here?

      Hello Diana Palacios,

Thanks for your question. I’m not sure about your specific situation of what to do about changing your residence permit application from being based on a relationship to being based on a student status. That unique circumstance would be best left for an email to Migrationsverket, and feel free to post back here with any info you find because there are probably others in your position as well.

You have probably seen the migrationsverket site that lists processing times for applications (http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Processing-time.html), and assuming you filled out everything correctly you should have heard from someone half a year ago. It’s definitely worth following your application up with an email or call about that as well to Migrationsverket.

      Good luck!

I answer my own question, with the email I got from the immigration office: “you cannot have two applications on going. You cannot start your studies until decision is made in your case. You need to have a valid permit in Sweden to be able to study. When decision is made in your current case and if it is positive then you can start your studies in Sweden.” I got my residence two weeks ago, too late to start the school this year.

Hello Cutie and thanks for your question,

It sounds like you have two options:

      1) Apply for a residence permit to move to someone in Sweden for marriage or a common-law partnership. In this case it doesn’t matter if you are married because you can also apply based on your intent to be common-law partners. You can find the details on this webpage (http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Planning-to-marry-or-become-the-common-law-spouse.html).

      2) Get married (either abroad, and I also believe you could enter Sweden on a tourist visa and then marry while you are there) and apply for a residence permit based on being married. More information on this webpage (http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse.html).

Whether you choose option 1 or 2, Migrationsverket says you must make your application from your home country, and that once you have made this application you cannot come to Sweden until your decision is made. The only exception I know of is if you are pregnant, in which case you might be allowed to apply and remain in Sweden while your application for a residence permit is processed, but this is not guaranteed.

Hope this helps, and good luck!

Hello Ben and thanks for the question,
As the parents of the baby, one of you would need to be a Swedish citizen in order for your baby to automatically become a Swedish citizen. It’s not like the USA where you automatically become a citizen if you are born there. As such you also can’t apply for a residence or work permit based on the fact your baby is born in Sweden.

      hello
Im a non EU-national and i have a danish girlfriend , we want to go to sweden and get married but we have one big problem (i overstayed my tourist visa) so technically im going to be illegal in sweden i need to advice on a few things
1- can we get a civil marriage even though i don’t have the right of residency? (Freedom of movement for eu nationals apparently requires one of us to be registered at the tax office) as i read online
2- if we rent an apartment and she registers at the tax office while still working in copenhagen would we still be able to get married?
3- after she registers at the tax office and we go to apply for a marriage certificate , would i get in trouble if they know that im illegal?
4- if we get married can i apply for a residency permit or card while im in sweden without having to go back to my home country? And can she apply for it instead of me?
I tried reading the migrationsverket but its pretty confusing and i couldnt get information regarding my case.
And can you please tell me what other options i have?
      Best regards
      Thank you

Greetings Qotandro and thanks for your questions,

1- As far as I understand from reading around the internet, it looks like it is possible to get a civil marriage in Sweden if your partner is registered with the tax agency, even if you are in the country illegally.
2- It seems that as long as your partner is registered with the Swedish tax agency you can get a marriage certificate, even if she is still working in Copenhagen.
3- From what I’ve read it looks like they don’t consider your immigration status when you apply for a marriage certificate.
4- The only possible legal way that I know of to apply and remain in Sweden while your residence permit is processed is if your spouse is pregnant or if you already have children together. This is not a guarantee to stay though- Migrationsverket will determine if it is in everyone’s best interest for you to stay while your residence permit application is processed.

Your spouse (or anyone you authorize) can represent you in the application process if you give her power of attorney. This is explained on both of these pages:

Migrationsverket planning to marry in Sweden
Migrationsverket moving to a spouse (including common law) in Sweden

It sounds official, but you could write up a power of attorney with a paper and pen right now as long as you address each issue mentioned on those webpages (state it is a power of attorney, include your name, date of birth, address, etc).

You could try the power-of-attorney route, but I would guess that eventually down the road you will run into trouble because you are in Sweden illegally. It might be something like you have to fly back to your home country to pick up your residence permit. I don’t have experience with this so I can’t offer any advice on how it might go.

You asked what other options you have, so of course I will add the obvious that you could return to your home country and apply legally from there. You won’t necessarily get into trouble or have any consequences if you return and apply from there. I know people who have overstayed their visa and nothing happened when they flew from Europe to their non-EU country, and they even subsequently returned to the EU and had no consequences (and got a Swedish residence permit).

In any case, best of luck!

    Hello,
I would kindly ask for some clearance about health insurance questions here in Sweden. I came to live here with my long-term partner that has a job here and now we decided to stay in Sweden. We are both EU citizens. We successfully applied for our personal number and just got them. To get my personal number I had to provide a proof of having a health insurance in my own EU country. Now I would like to know how I can get Swedish health insurance so I can stop paying the insurance in my country? Is it possible to get Swedish health insurance via my working partner here? Can you please explain what are my options?
Thank you in advance for your help and I really like the support you are offering here!

Greetings Barbara and thank you for the question,

First, congrats on getting your personal numbers. It seems that for many people, getting proper medical insurance in order to apply for a personnummer is the biggest obstacle. You are asking the next logical question about how to transition into the Swedish medical system, and the answer to this question does not seem to be featured too prominently on government pages or on the wider internet.

Let me preface by saying I haven’t transitioned into the Swedish healthcare system, so I can’t speak from direct experience – maybe someone else reading this post can?

The best article I came across on the internet for this subject was from The Local se. It detailed that the way you sign up for healthcare depends on the county (landsting) in which you live; each county manages its own healthcare system in its own way. Apparently each county has a dedicated number you can call to talk to someone about how to sign up for healthcare.

Once you have a personnummer it looks like you can register yourself with a local doctor or healthcare clinic (vårdcentral) of your choosing for non-emergency, standard healthcare. You might as well skip calling the county to ask about how to sign up and go straight to a doctor in your county because I’m sure they can tell you what you need to do to register with them.

Of course for emergencies and urgent situations you can go to local emergency rooms (närakuten) or a hospital.

The article I’m referencing for the above information can be found here: http://www.thelocal.se/20080822/13882

There is always private healthcare to consider, though I’m not sure how this compares with the public system. I would also guess that it is difficult to switch from one system to the other once you have made a choice.

And if your partner in Sweden is working he/she is definitely paying taxes for healthcare, and I would think could therefore stop paying in his/her home EU country. As for you if you’re not employed I’m not sure how it would work for you to stop paying in your home country. If you have a personnummer though it would seem like there may be a plausible way for you to do this. I can only suggest the obvious – that your partner’s employer or your county’s health department could offer you more specific information on this question.

Anyway, you’ve probably already thought of all those options already. Feel free to post back here on what you figure out. Best of luck!

      Greetings Nelly,
The first question is, do you have a residence permit or permanent residence permit for Italy. If you have the first, you can already move to Sweden, however this doesn’t automatically entitle you to a personnummer. If you have a permanent residence permit for Italy then I believe you can be considered an EU/EEA applicant for a personnummer. The process of getting a personnummer on this basis is explained on the following link under the heading, “If you are an EU or EEA member citizen from a country in Europe” (https://openbordersimmigration.wordpress.com/getting-a-personal-number-personnummer-in-sweden/).

You can also find an explanation on what you need for a personnummer on the above link for your other possible circumstances. If you have a short-term (five years or less) residence permit or no residence permit at all in Italy, then you would follow the instructions under the appropriate heading for non-EU citizens.

Thanks for the question and good luck!

    Hello.
    Im from Balkan country.
Met my wife 5 years ago.
She have been visiting me over this years 15 times.
I have visit her 3 times in Sweden.
Even the proves of pictures for this migrationsverket have never check and they have never ask her to show her passport stamps.
Married her from 1 year and 8 months.Marriage is registered in Sweden legally.
Also applied for residence permit from 1 year and 8 months.
Waited 14 months and application was rejected.
Reason….the relationship was not true because my wife have been married before with someone else from syria and got divorced. He married right after and his new wife got residence permit.
We appeal to the migrationsverket court of appeal 5 months ago.
Now my wife is pregnant 3 months.
We have send the ultrasound to this court but doesnt seems to help.
We got told that being pregnant doesnt mean anything for migration officers. And also they dont have any idea of how long more it will take for a decision.Or if will be positive or negative.

We dont know what to prove more to them.
    What to do more?

Im afraid of being rejected again.

How can the do this to tear families apart?

      Hello Remi,
It sounds like you’re in a very stressful situation. I’m afraid I can’t advise anything else for your situation. It sounds like you are in contact with the immigration people working on your case and they will tell you everything you need to do.

Perhaps I can reassure though- when you applied for your residence permit 20 months ago you had also gotten married just around that time. Now that you have almost been married for two years it could look more like a “real” marriage in the eyes of migrationsverket.

As for your wife being pregnant, according to this migrationsverket webpage (http://www.migrationsverket.se/English/Private-individuals/Protection-and-asylum-in-Sweden/If-you-have-or-are-expecting-children-in-Sweden.html) you do have the possibility of remaining in the country while your application is processed. Read the part under the title, “If you have or are expecting children in Sweden.”

It sounds like a horribly stressful time. Very best of luck for your case to go through well!

We got answer that being pregnant don’t mean that the relationship is true.
Now I sit here and understand how stupid are they.
We are married from 2 years and living 2000km away and now expecting a child.
They keep saying that if more information is needed they will ask but they just make decisions just like that.
Really, it feels like applying to North Korea.

But is there any law for this?

I don’t want be a part time father. Just visiting my family once in 3 months like a tourist.

It must be a law in Sweden for children and family that can regulate this. Or not?

        ADMINISTRATOR REPLY:

Sorry to hear that is the response they gave you. Once they give you a decision they should also detail what your options are for an appeal. At this point you might decide that contacting an immigration lawyer in Sweden is a good idea.

Here is a website that lists immigration organizations in Sweden that offer assistance for free: http://www.refugeelegalaidinformation.org/sweden-pro-bono-directory. These organizations deal with immigration issues that relate to refugees but may also have some ideas of what course of actions you can take.

All the best of luck for your very frustrating situation

      Hello Nelly,
Yes, I believe you are correct. Here is a detailed pamphlet about getting the personnummer as an EU citizen (this is basically your situation as a long-term Italian resident): http://www.skatteverket.se/download/18.8dcbbe4142d38302d74be9/1387372677650/717B06.pdf
This pamphlet clearly says you have the right to start working once you find a job within three months of arriving in Sweden. Once you get that job then you can register with Skatteverket and get your personnummer. However in my experience it seems employers don’t know how to hire someone who doesn’t have a personnummer, which can make for a very frustrating situation. In any case, good luck!

For anyone else who has a question on this topic you can find more info on this page about getting a personnummer: https://openbordersimmigration.wordpress.com/getting-a-personal-number-personnummer-in-sweden/

Hello I am from Philippines working as Aupair here in Denmark. I just really badly need advice. He doesn’t have a job at the moment because he under SU and therefore we can’t afford to pay to get marry here in Denmark. And it’s impossible for him to keep me here close to him. That’s why we looking for another option jus like moving to Sweden and get marry there. We both are in a right age I’m 31 and he is 42. Now, my question is that is it possible for our situation to get marry and move to Sweden? Can we move there right away while we are waiting for the processing for my resident permit? Please anyone can give as good advice what to do. We are getting hopeless and disparate in our situation right now. I am looking forward to hearing any helpful advice. Thank you so much. Greetings,

I looked around the internet and found a helpful page for your situation from the Swedish Federation for Lesbian, Gay, Bisexual and Transgender Rights (RFSL). It details exactly what you must do to get married in Sweden (it’s the same process):

(the link expired- here is a new one about getting married in Sweden: http://www.huffingtonpost.com/2012/02/09/getting-married-in-sweden_n_1265800.html)

You need to fill out this form and submit it to Skatteverket: http://www.skatteverket.se/privat/blanketterbroschyrer/blanketter/info/7880.4.19b9f599116a9e8ef36800024527.html

It looks like to get married in Sweden under your circumstances you both must have the right to marry in Denmark. You must also have a Danish residence permit. You will still need to get a Danish marriage license, and then bring this to Skatteverket. So unfortunately you still come back to the roadblock of getting a Danish marriage license.

However, you can be considered a common-law spouse if you have lived with your boyfriend for at least two years. In this case, you could move to Sweden together and then you could apply for a residence permit based on being a common-law spouse. To do this you would need to meet the requirements for a residence permit (minimum income or savings, health insurance, etc).

He would need to meet the requirements to stay in Sweden as a Danish citizen, and actually Sweden makes this easier for citizens from Nordic countries like Denmark. Here is the information that he should read: http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Nordic-citizen/Permits-for-family-members/Residence-permit-in-accordance-with-Swedish-regulations.html.

Hopefully this helps and you can stay together!

      Hello Joaquina,
The main thing I would be worried about for the visa in your passport is the length of its validity. Is it only for three months or for some years (such as five years)?

If you are married to a Swedish citizen and the marriage is registered in Sweden then you can you can apply for a personnummer that you can use to get a job, get into the healthcare system, and all the other important things. You do this through Skatteverket (http://www.skatteverket.se/) once you are in Sweden.

It’s a separate agency (Migrationsverket) that deals with your residence permit and visa. As such I wouldn’t be too worried if it says you are a student, assuming this doesn’t affect the length of your visa’s validity. It never hurts to check with Migrationsverket either.

Thanks for the question and hope this helps

Unfortunately…The main rule in Chapter 5. § 18 Aliens Act is that the applicant is located in the home country during the period is in progress and that one entry may result in complications for the application. The processing may take longer if the Migration Board prior to the time the decision becomes aware that the person stays in Sweden and therefore must wait for an exit. The applicant also risk getting denied and being rejected, if he or she remains in Sweden at the time of the decision.

Migration Board advises thus seekers from traveling to Sweden during the wait for a decision, whether the applicant is a visa or not.

Although, I asked the embassy in my country (Mexico) and they answered, it was OK, but only for short periods.

Non EU-citizen married to Swedish citizen with Swedish citizen (dual-citizenship) children, for over 5 years.
    All living in non-EU country.
Swedish citizen is currently unemployed in non-EU country and not entitled to any benefits under Permanent Resident visa.
Non-EU citizen is employed but does not want to be unemployed in Sweden, without a resident permit/work permit for an indefinite period of time.
    The following questions we have:
    1) We have rang MV in Sweden and they have stated the general rule of applying in the home country then we have been given a time period of 12-20 months until the non-EU citizen receives the resident permit. As we have children, is there some kind of “priority” processing, and does anyone know how long this would take? Has anyone been through this situation with Swedish citizen children?
    2) We could move to Sweden (the Swedish citizen has been offered a job in Sweden), and apply from there. From what I understand from this page (http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse/If-you-are-in-Sweden.html), I (the non-EU citizen) fulfil this criteria, is there a “priority” processing time given we have children?

Hello Andreas- hopefully someone who has been in a similar situation can provide you with some very relevant answers to your questions here.

I can mention that you are not necessarily guaranteed a residence permit (based on your children’s best interests) if you apply for this while you are in Sweden. However because of your situation I would hope that Migrationsverket could give you a better answer. Good luck, and I hope someone else posts more detailed information on this question.

      Greetings Austine,
This response assumes you do not have a permanent residence permit in Norway (if you do then I believe you don’t need a residence permit in Sweden).

The application procedure is detailed on Migrationsverket’s webpage for Spouses, Registered Partners, or Common Law Spouses: http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse.html.

Unfortunately, this pathway doesn’t allow you to apply from within Sweden. However Sweden has special rules for people coming from the Nordic countries, so I would suggest talking with someone from Migrationsverket about your specific situation. Feel free to post back here if you find any useful information from them. Good luck!

Hello Muqaddis and thanks for your question,

I haven’t seen anything about gaining permanent residency based on owning property. The requirement that is consistently mentioned for permanent residency is living five years in Sweden.

      http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/After-five-years-in-Sweden/Permanent-residence-card.html

This Migrationsverket page talks about gaining a permanent residence card, however it doesn’t address the situation of two non-EU members living in Sweden for five years (I’m not sure what your situation is in this regard). Nonetheless I would still guess that you first need to live in Sweden for five years.

      Good luck!

You can find the estimated waiting time for your application here: http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Processing-time.html

As long as your Swedish spouse registered your marriage with Skatteverket I don’t know of any reasons why your application for a residence permit would be rejected- you just need to patiently wait. Of course this assumes you are applying from Albania and are there right now.

As long as your are married, and neither of you are currently married to anyone else (if you separated from a spouse years ago but didn’t file for a divorce this can be a problem), then I believe they must take your marriage certificate at face value. Of course if they are suspicious of your marriage they will make inquiries to investigate this. Don’t get stressed out waiting because it can take a long time.

    Hello,
    Please explain me.
My spouse is EU citizen (Romania), I am non EU family member (Russia).
How much money need for me to support yourself in Sweden?
If I have the savings can they be the proof of my ability support yourself?
For what term do I need to provide proof of support yourself in Sweden (6 months, 1 year, 2year)?
Must my spouse (EU citizen) submit the proof of her ability support yourself ?
As written “The maintenance requirement does not apply to you if you…are a citizen of another EEA country.”https://www.migrationsverket.se/info/4442_en.html
Does this mean that maintenance requirement is only for me (non EU family member )?

      Hello Sergey,

Thanks for your question and you are right to wonder- it’s hard to find information about the exact required amount of money you must have to get a residence permit in Sweden. You appear to be correct that your wife (an EU citizen) does not need to meet the maintenance requirement.

I can also say that I don’t know for certain what the financial requirement is for non-EU citizens, however I can tell you that the following worked for me to obtain a five-year residence permit:

My wife (EU citizen) and I (non-EU citizen) arrived to Sweden with around 3,000 euros savings. My wife was enrolled in school for an eight-month program for which she got a stipend of 7,300 SEK per month (note, at the time this was the minimum amount required to support yourself- now it is a bit higher). She first registered herself as living in Sweden, and then I applied for a residence permit. After a few months my application was successful.

The entire time my application was being processed (about 4 months) I was not working. I submitted copies of my bank account showing savings with my application.

I think the most important aspect of this application was that my wife was earning the minimum amount (or close to it) required to support two people.

You can find this amount here towards the bottom of the page: http://www.migrationsverket.se/English/Private-individuals/Studying-in-Sweden/Universities-and-university-college.html

I’m guessing these are the money figures required for anyone applying for a five-year residence permit, though I’m not positive. To summarize these figures: 8,010 SEK per month for one person, 11,510 SEK per month for two people, 2,100 SEK per month for each extra child.

This raises the obvious question of how long you need to provide proof of this income, and unfortunately I can’t provide this answer. I can say that my wife showed proof of her school funding for the eight months we were scheduled to be there. On my residence permit application I also wrote I would be there for a year, however the permit I received is valid for five years.

    Hello,

I am a non-EU (American) who has been married to a Portuguese citizen for 5 years. We are living together in Sweden now, and I have received a personal number. Unfortunately I am waiting for 16 months for my ID card to be approved (and it’s only been a few months now) due to the increase in migrants to Sweden.

I want to ask about healthcare in this scenario. I am not an EU citizen, but I am living in Sweden legally with a personal number and I am allowed to work and pay taxes while my application is processed. My partner is also working and paying taxes. The only information about this I can find is for people who already possess residence cards (covered like a Swede) or are in Sweden for a brief stay (tourists) and do not possess personal numbers. I cannot find any information about healthcare in this weird grey area I’m in.

What does not help is that I have called the 1177 number a few times and have received conflicting information each time. I was told once that I’d need to pay for everything out of pocket at full cost. I called again this morning and was told that I pay a reduced fee (50 kr for a doctor visit for example) but that it wasn’t free like it would be for someone with a residence card. I asked at migrationsverket and no one knew what to tell me.

I am dealing with a medical problem right not that is not “serious” but does need attention to avoid becoming serious. But I can’t afford to pay 2000 kr to see a doctor right now. Can you help me find where to get the correct information?

    Regards.

Hello Soma and thanks for your question,

I believe you need to remain outside Sweden for more than six months before you can go there again on a three-month visa, and you can only do that once in a 12-month period.

Once you are married you can apply from Kenya, and the current waiting times are listed on this site: http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Processing-time.html.

Unfortunately right now it seems like a longer processing time — 70 percent of applicants are processed in 14 months or less.

Best of luck (and patience!), congratulations on your upcoming wedding

Yes, I believe you could visit any Schengen/EU country (but not Sweden while your application is being processed) under normal visa circumstances.

Of course, they can always reject your application after any amount of processing time- there is never a guarantee. However because you will be married to a Swedish citizen, if you meet the requirements then you have the right to live in Sweden with your partner. So I think as long as you make a complete application it’s just a matter of being patient for your residence permit.

    Dear Administrator,
Thank you so much for all the answers you provide the ones who are in a need of such important information. This will probably be the millionth time you have heard the following question but just for me to make sure I’d like to kindly ask you to explain to me what this whole procedure looks like:
I’m Ukrainian, married to a Polish national and have been living in Poland with a Polish residence card for 4.5 years now. I and my wife would like to go to Sweden, what do we need for the start/what’d be the best for us to start with?
We could very unlikely show an impressive bank account in order to be considered self-sufficient in Sweden and we get medium salaries (as for Poland) here. So in our case, would it be the best if my wife first found a job in Sweden and then, having got a contract from work, based on which I could apply for a 5 year residence card in Sweden or would we still need to show savings on our bank account?

    Reply
    1. Administrator Post author

Hello Stanisław and thanks for your question,

First, you may find it easiest to obtain a long-term residence card for Poland. I believe you can be eligible for this once you have lived in Poland for five years. Once you have this you could move to Sweden and have basically the same status as an EU resident (http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Long-term-residents.html)

If you don’t do this though, it’s okay and you should still be able to move to Sweden with your wife. This process is detailed here, written from the perspective of what your wife will need to do: https://openbordersimmigration.com/immigrating/immigrating-to-sweden/how-to-get-a-swedish-residence-card-uppehallskort-for-family-members/

It would seem like your application would have a better chance if your wife first found a job. But as long as you can show you have enough to support yourself (10,800 SEK for two per month) and some savings you might as well try. From my experience my wife and I had about 28,000 SEK in savings, and she had a contract that paid 8,000 SEK per month, and I got a five-year residence permit from that.

Hopefully that helps, and best of luck!

Thank you very much for your response and your wishes!
I hope you will condone me in asking you one more thing:
What if a non-EEA/EU spouse of an EEA/EU national gets a refusal for their Swedish Residence Card? Should that person leave Sweden then? If yes – that’d then be a human rights abuse from the Swedish side, ‘cos by this, they would force the married couple physically split up due to making it impossible for the non-EEA/EU spouse of an EEA/EU national to stay legally in the country.
The Directive says that a non-EEA/EU spouse of an EEA/EU national is not obliged to acquire a Residence Card but it would only make it easier for them to prove their residence right in that country. So what could happen if a non-EEA/EU spouse of an EEA/EU national just stayed in Sweden with a refusal and continued to live there with a polish RC (but not a long-term one)?

      2. Administrator Post author

Yes, from one perspective it seems unjust to deny a residence permit to the spouse of someone, especially for reasons that relate to money (and I have been in this situation). On the other hand, all countries I have experience with (USA, Sweden, and Germany) – and I suspect most countries – do this, not only Sweden.

I would guess the worse that could happen is deportation, maybe some time in jail, and a prohibition from returning to Sweden. Realistically though, I would guess that until you became “legal” you would not be able to enter the social system, medical system, pension system, employment system, etc.

      3. Stanisław

        That doesn’t sound quite promising.
I think, that’d be the time to hire a lawyer if they’d have to resort to such violent anti-human actions like dispersing a married couple by force due to the lack of money – if that’d be the case.

Do you know if it’s possible to first apply for a Swedish RC before moving to Sweden? Be it in Poland for example, at the Swedish Embassy (if they carry that out in practice at all). So that we wouldn’t have to risk wasting our time traveling to Sweden, finding a job there and then getting a refusal from the Swedish Immigration Centre just ‘cos there was not enough money on our bank account.

      4. Administrator Post author

That’s an interesting question- applying for a RC as the spouse of an EU citizen before either person has arrived to Sweden. I don’t know of anything like that- if you find something then post back here because that would be interesting.

    Hi there.
I’m a non- eu citizen, I met my swedish bf years ago in canada and we lived together for one year and a half there and then a full year in mexico.. He had been back and forth during all this time. We have applied to get a resident permit and its been 10 months now since that day… After we applied for it I went to visit my bf in sweden for the 90 days permited and I even got my finger printed in solna while i was visiting since I had to get and extension for 15 extra days due to a few problems with my flight back to mexico , so the migration was aware of our situation and they said everything should be fine as soon I didn’t go back to sweden again and until I finally had my resident permit. While being in sweden i got an email from migrationsverket telling me that it was time for me to attend my interview at the swedish embassy in my country, Mexico , so I had to go back to mexico to get interviewed and i did. Right now I don’t know what is the situation with all the immigrants coming to Sweden , and the time is killing us .. Do you think my residence permit will get to me soon, Is it normal the time we have been waiting for it??.. does this has something to do with me being in sweden for a longer period?? what would you recommend us to do right now.??

Thank you so much for this website, I would appreciate to get feedback from you..
    Thank you.

Hello Vanessa and thanks for your question,

Flying from Sweden to Mexico so you can have an interview at the Swedish embassy…don’t get me started!

I think your best indication that everything is okay is that Migrationsverket told you just this. Don’t worry, you just need to be patient, and anyway there is nothing more you can do for your application at this point. You probably have seen this website that shows processing times for the residence permit: http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Processing-time.html

It never hurts to write an email to Migrationsverket and make sure your application is still being processed. They have been known to make mistakes so you can always check.

Best of luck and hopefully it comes soon!

First i really want to thank you about how you are helping people which maybe you never met and you will never meet them.
so ,could you tell me please if you have any idea about my case an, i am NON EU and i live in EU zone i have a Permanent Residence card (valid for 10 years , but not CE ) and i applied for Swedish residence permit ( as sambo with swedish citizen )

it will be the same time for non EU citizen or my residence in Europe will give me some exception.

    thank you in advance

Hello Koubid and thanks for the question- I believe you will go through the standard process for non-EU citizens. That is if your long-term residence card from another EU country is not on this list:
      http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Long-term-residents.html

If your long-term card is on this list then I believe you don’t need a residence permit for Sweden, you only need to register with Skatteverket to get your personnummer.

      Good luck!

I believe he can join you now. As a non-EU citizen he can presumably stay in Sweden for three months (depending on which country he is from), and can apply for a residence permit to stay longer on the basis of being married to you. I believe in this case he (or you both combined) will also need to have a monthly income of around at least 10,800 SEK (total for two people combined). He’ll also need health insurance. Hope that helps

I have got my UT cards for me and my children and we should join my husband in Sweden. the decision date is 3.10.2015 but the UT cards issuance dates are for the young children 12.10.2015 and for me 21.10.2015.. my question,,, is there is a specific time for example 3 or 6 months that I should travel to Sweden before.. or is there is any legal issues in being late more than 3 months to reach Sweden.. my employer is making things difficult for me and doesn’t want to release me before 3 months….

    Thanks & regards,

I’m not sure but I think the only issue that would matter is how long your UT cards are valid for. As long as you go to Sweden before they expire I think you should be okay. Good luck, maybe someone else has more to add

Hello Tuff, to apply for a residence permit in Sweden you need to do this based on some status, such as being a student, common-law spouse (if you lived with your girlfriend for two years you could apply based on this), or spouse. In any case it would take months and I don’t think there is anything she could do to speed up the process. Sorry it’s not better news, and best of luck

    Hello,
I was wondering if you could please advise on the following. I am a non EU citizen married to an EU citizen working in Sweden. As such, I just recently joined my husband who is working in Sweden and I have applied for a residence card. However I will have to go to Italy for my PhD defence at the end of January and it is highly unlikely that I will receive my Swedish residence card by that time. Is there anything I can do to ensure my free return to Sweden after the PhD defence in Italy?
    Many thanks

    1. Administrator Post author

Hello Jasna, I believe the answer to your question could be easy if you are allowed to stay in Sweden (and the EU/Schengen Zone) as a tourist for three months, and your time in Italy and returning to Sweden is within this three months. In this case I believe you have free movement in the EU/Schengen area for this amount of time. However you could still potentially run into trouble at an airport in Italy, for example, if someone required you to have a return ticket to your home country because they saw your three months were about to expire in the EU/Schengen Zone.

If you needed a visa to enter Sweden then I believe you will have more trouble with this and I would refer you to this person’s situation.
      Good Luck

Hi there!I am an EU citizen i got married with my wife almost 2 months ago.How do i get a residence permit or personnummer?i applied at the migration last year as Planning to marry or become a common law spouses…tough i didnt get any response yet and in the meantime we got married. As i understand the personnummer you get it from the tax office and the residence permit from the migration board…the tax office officers they got me until now wrong information telling me that me and my wife need to have lived together OUTSIDE of Sweden and such( its like a swedish citizen cant get inlove to a foreigner or met someone in Sweden and get married and so on, while they are in Sweden) ! My wife is Swedish and im from EU.We meet almost 2 years ago online and i decided to move in Sweden to live with her after 3 months. We lived together ever since and we got married 2 months ago.Its fucking frustrating because on the phone they say one thing and in person another thing. So how do i apply to get a personnummer and the residence permit?im totally confused here… i dont work but i have opened a ”company” trying to do something ( im a photographer ) then to hit walls because i cant operate nothing because of the damn personnummer i cant have bank account to manage my company finances taxes and so on ( a fucking nightmare ) so im basically stopped in my tracks , its a damn paradox! Registered to arbetsformedlingen more than 4 months ago and that doesnt help with nothing ( not if you dont have high skills and degrees and such ) town is small arbetsformedlingen didnt helped me to get any damn job, you can find jobs yourself, arbetsformedlingen is just useless…( sending them activity reports for what…) .So the idea that we need to go and live outside Sweden and the return to Sweden so then i can apply for residence permit its outrageous!I guess the tax office agent was high on snus or something or they are doing it on purpose as i saw in many cases…so basically my wife is married with ”no one” i dont appear in any system that i live with her on this address and so on.On the personbevis that is on her name…is stated at the end the name oh the husband and thats it …no folkbokforing info for me because im from ”no where and i live in…no where”.I dont even appear that i live with my wife.

Hello Gheo- it sounds like a completely frustrating situation you’re in. In any case congratulations on your marriage.

Perhaps what is confusing people is that you first filled out an application as planning to marry a Swedish citizen. In this case you have to live outside Sweden until you are approved to come and marry. To try and solve this I would say talk with Migrationsverket and tell them you want to cancel this application. If it’s possible get a receipt or confirmation that your application is cancelled and then you can show this to the people at Skatteverket.

Actually coming to Sweden as a tourist (or just taking advantage of your right of free movement as an EU citizen) and then getting married while you are in the country is not addressed anywhere that I can find with Migrationsverket or Skatteverket. I talked to one other person who was in the exact same situation as you. She said that when Skatteverket is processing you for a personnummer, they say what comes first is your marriage and that in your case the fact that you are an EU citizen is secondary. Meaning, your eligibility for a personnummer depends on your marriage rather than the fact that you are an EU citizen.

Theoretically to apply based on your marriage, you and your wife need to take your marriage certificate to Skatteverket and register your marriage. Then theoretically you can apply for a personnummer.

This is my best understanding of the process. I’m afraid you have a future of waiting in queues at government offices ahead of you, but hopefully eventually it will get straightened out. It’s ironic because it seems like it should be easier for EU citizens, but actually it seems to be more complicated.

If you find out any information along the way then feel free to post back because then we can figure out the actual confirmed process for those in the same situation. Best of luck for your frustrating situation.

    Hello again Tuff,
I would think that you can apply for a residence permit based on being a family member in Sweden, no matter what other applications you have outstanding in other EU countries. However this is just a guess- I don’t have experience with this specific situation.

I think you would apply as a non-EU citizen if you don’t have any long-term documents from Germany (l don’t think Germany is giving permanent residency to asylum seekers), and also pay any associated fees with the application.

And just to confirm- you lived with your girlfriend for less than two years, correct? If you lived with her for at least two years then you can apply for a residence permit in Sweden as a common-law spouse. If not then you apply based on “coming to Sweden to with plans to marry someone

    Good luck

        Hello Tuff,
I’m not sure about the specifics for scanning your documents- maybe someone else reading will know.

As for how long she can stay abroad, and how/if that would affect your application for a residence permit, I’m afraid they are too technical for me to answer. Again maybe someone else reading will know, and I would also recommend asking someone at Migrationsverket this question- they should know for certain.

For the payment, I’m not sure on this question either. As you point out, the page is ambiguous if you must pay the 1,500 SEK fee or not. (http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Fees.html) The question is, as a future spouse/common-law spouse of an EU citizen, do you need to pay? Another question for a reader or Migrationsverket.

Sorry not to be of more help on this one. If you find any information from speaking with Migrationsverket feel free to post back with what you learn. Good luck

      Hello Sam,

As I understand they are basically an equivalent status, except a marriage is performed in a church and a civil partnership is performed in a court room. It’s no problem for same-sex marriages or civil partnerships in Sweden because the law is written in gender-neutral terms.

I believe you may be asked to provide an official document from your home country that says you are not married or, if you have been, that you are legally divorced.

Perhaps someone else reading has more information, and if you discover anything else please post back here.

My husband has already registered me at the personbevis so i have a personal number which i understand can assist me to get a job in Sweden when i move there. My question is can i apply for residence permit while am on visit visa in Sweden since i want to settle there? or can i apply for residence card basing on the EU rules?. On 23rd December 2015 i was rejected a visa reason not being established in my home country yet my husband is the one supporting me at all times. Second, can i apply for residence permit in my home country then visit Sweden with a visa if granted (appealed yet to received feedback). Can my child(not Swedish) who is above 18 join me in Sweden when i get the residence permit. I will appreciate your feedback on this disturbing questions. Thank you.

Hello Chepkie, I believe the official position from Migrationsverket is that if you are not an EU citizen then you must apply for a residence permit from your home country to move to your husband, and not come to Sweden until you have received this.

You can find more information about your child (who is over 18 years of age) moving to you through this link: http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Close-relative.html.

As for traveling to Sweden while your residence permit application is being processed, or applying for a residence permit from within Sweden, there are many different situations talked about on this website- see the Comment Directory under the heading, Applying for a Residence Permit/Personnummer Inside/Outside Sweden.

      Good luck!

You just need to read through the information in this link: http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Work-study-or-live-in-Sweden-for-EU-citizens/Residence-cards-for-family-who-are-non-EU-citizens.html

If your husband needs a visa to come and meet you then he can find information on how to apply through that link. The visa is simply giving him permission to travel to Sweden (if he needs permission).

Then he can travel to Sweden to join you and apply from within Sweden for his residence card.

Hi there! First of all, thank you for being so incredibly patient and informative with your replies!

I tried hard to search for an answer to my problem within the comments but to no avail. 😦 I think perhaps my situation is a little different.

I am dating a Swede but am currently working in Malaysia doing the whole LDR thing. My plan to is apply for a Masters programme in Sweden for the academic year starting Aug 2017.

I am still somewhat unsure of how to go about things. I can only afford to move to Sweden if I get into a masters programme AND be exempted from tuition fees. Which requires me to obtain sambo residency prior to that.

Could you advise on if the following:

    1. Is there a stipulated time period within which you must move to Sweden, after being granted residency?

    2. Does migrationsverket take into consideration the preferred date of my moving to Sweden as stated in the form? (I.e. If the approval comes in Dec 2016 and I’m only able to move to Sweden in Sept 2017. Would that be a problem?)

    3. Is being granted residency enough to qualify for university tuition fee exemption? Would I require the Personnummer or ID card?

Thanks so much for your help!

Hello Emily and thanks for reading,

First, I’m not sure about a time period in which you must move to Sweden, or about preferred moving dates. However, I can tell you that when I applied for a residence card I specified I would be there for at least a year and possibly longer, and the residence card I received was valid for five years (and my spouse only had a secured source of funding – a scholarship – for one year). I would think that as long as you have a valid residence permit you can come and go as you please, however with the sambo (moving to Sweden with plans to marry someone- for anyone else who may be reading) I think you are wise to ask this question. Maybe someone else reading will have some knowledge about this.

You’ve probably already researched this, but I’ll mention it anyway. I know for some (perhaps many) university programs you can be admitted/get scholarships even if you are not a Swedish or an EU citizen. For example, the graduate program my wife did had students from the US, Ukraine, and Azerbaijan who got full scholarships.

Hope this helps, and good luck!

      Hello Lori,
Yes, that is a very hard and frustrating situation to be in. The only thing I can think to suggest is that when your husband applies for a residence card, perhaps he can indicate that he only plans to stay for one year (if you have enough savings to meet the minimum income requirement for one year, or maybe even just six months).

It sounds like you are taking all the necessary steps to find a job, so once you do that then it should be no problem for him to apply for a residence permit for the standard five years, and afterwards permanent residence.

      All the best of luck!

Hello Admin’ Thank you for all the helpful information you have posted in your website’.
I am a Swedish citizen who been living in Canada for almost 22 years and never became a Canadian citizen because I was afraid to loose my Swedish citizenship. I remarried and registered my marriage in Sweden 5 years ago and applied for PR to bring my wife to Sweden within Canada but her application was rejected based of I being here in Canada and was asked to show my plans regarding work or residency in Sweden which at the time I did not appeal and
decided to apply to bring her to Canada instead but unfortunately I had a un discharged bankruptcy from 2007 and could not apply for her PR until 2014. Again on December 7 of 2015
Canadian immigration rejected her Application based on very unreasonable grounds and asked me to go to a hearing which in that point I withdrew my file and decided to go back to Sweden.
I will be moving back in 2 weeks from now since I have lost my hope to a system which failed me as a tax payer in this country after so many years. My question is if I need to fill another application while I am in Sweden? Do I need to show a Maintenance report as a Swedish Citizen? Any help and suggestion will be highly appreciated. Thanks again

      Hello Pariz,

That’s surprising to hear how it went in Canada- it sounds difficult. Hopefully you will have a better time back in Sweden.

If you have an outstanding application with Migrationsverket you should contact them and say that you want to modify your application instead of submitting a new application.

If you have already received a decision from Migrationsverket then you should also be able to appeal that if you believe it is an incorrect decision.

Otherwise you can make a new application, but if your circumstances are the same and it hasn’t been long since your last decision then I don’t think Migrationsverket would reverse itself.

According to Migrationsverket’s webpage, you are not subject to the maintenance requirement if you are a Swedish citizen. (https://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse/For-the-relative-in-Sweden/Maintenance-requirement.html)

Since you can read Swedish you are already a step ahead of most people, so I would recommend reading through Migrationsverket’s website for better answers than those I could give you.

      Good luck

        Hi there,
I am Senegalese married to a Swedish Citizen currently living in Senegal.
We have two swedish children together and I was wondering if there is a way I could get a Residency Permit even though my spouse is unemployed in Senegal but I however am Employed and providing for them all.
One of our daughter is sick and we would like to go to Sweden for check ups from time to time without having to wait for visa approvals.
        Thank you so much.

    Hello admin!

My partner is from a None-EU country but doesn’t require any visa to enter Sweden.
We applied to live together in Sweden long time ago and soon our application will start to be proceed, or “considered”.
As I already live in Sweden and have a permanent residency.

Wanna ask what would happen if my partner visits me in Sweden, if it’s such as a normal visit, and under which reason or law do they say in migrationsverket that:

“You may not enter Sweden while your application is being considered. Your permit must be ready before you travel to Sweden.”
    – as written in the link below, under the band number (6) :

    https://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Planning-to-marry-or-become-the-common-law-spouse/How-to-apply.html

Why isn’t it allowed to my partner to visit Sweden? and what would happen if my partner does visit Sweden normally and without breaking any rules?

Thanks a lot for the useful answers,
    anonymous.

      Hello,

Yes, I agree that rule doesn’t make much sense, especially if your partner would normally be allowed to come as a tourist. As for the legal justification behind the rule, you would have to ask those who made it.

Others have written on this forum that they/their partners have visited Sweden while the application was being processed and it didn’t cause any problems. It seems like it is one of those things you do at your own risk.

      Good luck

    Hello once again Mr Adminstrator?

My girlfriend send Migrationversket a mail regarding my issue, if I can do the application base on being asylum seeker in another EU member country. But she didn’t get any reply yet… I also talk with both Span, Italy & Germany Swedish embassy’s and this is what they said to me?

    Spain;
If you are a legal asylum seeker with passport her in Spain you may apply for a Swedish resident/work permit to move to your partner in Sweden.

    Germany:
You can apply for a residence permit for Sweden on family ties. On the Homepage of the Swedish Migration Agency you’ll find detailed information.

    Italy:
    You may apply on-line.

Mr Adminstrator pls help us we both confused with my girlfriend… should we wait until we hear from the migrationversket, or we colify to do the application. tnx?

    Hello Tuff,

You have really been doing your research and talking with all those countries. Unfortunately those officials haven’t answered any of your previous questions about the family/non-family application fee, or applying as an EU/non-EU citizen.

Hopefully Migrationsverket will answer all of your questions clearly so you know what to do next. I can’t advise you either way on waiting for their reply or making an application now. It’s hard to say when they will respond to you, but modifying an application you have already submitted will take some time as well.

Maybe someone else reading will have a better answer for you. Best of luck

Hello Ella, I believe as long as he makes an application for a residence permit before the three months expire then he can stay while it is being processed. This was how it was for me and it was fine- I don’t think a US passport is different than any other non-EU passport in this case.

As I understand, if the application is rejected then you have the right to appeal, and if the appeal is rejected then he must leave. However, as long as you both have enough to support yourselves and have medical insurance then I don’t think his application will be rejected- he has the full right to be in Sweden as your spouse.

Good luck and have a nice weekend as well!

Hello once again!thank you fir your answer sir and if i may can a ask you another question?if he get rejected and we appeal and rejected as well of course he will leave but can he come back and apply again after for exemple we have fixed the problem or the reason why he did get rejected?because for the moment now i am in a practice contract and after 3 months i get the employment.if he gets rejected for this reason can he come back and apply after 3 months when i had start the job?because its very unfair that if we apply and appeal rejected both than he losses the right to apply again after we have fullfill the condition.
        Thank you sir

      2. Administrator Post author

        Hello again Ella,

I would advise that when you apply also show proof of your practice contract and tell Migrationsverket that you should have a normal contract in three months. Also tell that you are applying before you have your normal contract because his 90 days will run out soon. It seems they should be able to see your situation is okay, and at least issue him a residence permit that is valid for a six months or a year, then he can apply for a permit that is valid longer.

Anyway, here is the Migrationsverket webpage that explains what to do if the application is refused: http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse/After-the-decision-has-been-made.html

One other thing you can try is extending his visa, then applying for a residence permit later once you have a normal work contract: http://www.migrationsverket.se/English/Private-individuals/Visiting-Sweden/Extend-a-visit.html

This raises the question: what if the application to extend his visa is denied and his 90 days have already passed? I don’t know the answer for this, so if you try and extend his visa, I would also say speak with someone in Migrationsverket, tell them the situation, and ask if it is okay to apply for a residence permit if the visa extension doesn’t work.

        Best of luck!

Don’t worry- you just need to wait to see what Migrationsverket says about the application. Maybe the application will be accepted. If not then you can make an appeal, and hopefully by then you’ll have a normal work contract. You can always email or call Migrationsverket to ask for advice on what you can do.

Admin- Thank you for the very informative website you have created, I wish I would have come across it sooner.

My question to you is; my wife has been living in the US with me(a US citizen) for over 12 years and now she also has a US Citizenship because of it, she is also a Swedish citizen.

We plan to move to Sweden in the next 12-24 months after she finishes her MBA. I recently filed, but I am reading some individuals have been denied due to the fact that they do not have direct plans to move to Sweden. Will an exact date with predetermined employment cause issues? I feel like the Swedish Migrationsverket site is somewhat contradicting in this aspect so I am unsure of the clear answer here.

To add to all of this while visiting the immigration office outside of Stockholm we where both advised that we would have to move to Sweden and apple while I was in the country…

    Thanks in advance.

Hello Tintin, unfortunately I don’t have a clear answer for you either. However it sounds like many of the red flags for Migrationsverket – short-term marriage, unemployment, etc – are definitely avoided in your situation, so I would suspect that your biggest potential hurdle would be just waiting for all your paperwork to go through (however you end up applying).

Even though it contradicts the information on the Migrationsverket webpage about “moving to someone in Sweden” who is your spouse, if they told you to apply once you are already in Sweden I guess you can follow those instructions.

Interesting to hear that is what they advised. Hopefully your wife speaks Swedish- that can be the best asset for navigating the ambiguity.

Feel free to post back with what you ultimately find works- I’ve been in contact with several people in your situation, and the solution for what to do has thus-far remained ambiguous.

      Good luck!

i am married to a finnish citizen with 2 children .i have a resident permit A but want to move to sweden. How do we go about it

    Reply
    1. Administrator Post author

Hello Tojat- I’m not sure how the Finnish Permit A translates to the residence permit/permanent residence permit in Sweden, however I believe this would only be an issue if you were applying for a Swedish residence permit based on being an EU permanent resident- in fact you will be applying based on your status as being married to an EU (nordic) citizen. So to answer your question:

Finnish citizens are part of the Nordic Agreement Sweden has with its neighbors: http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Nordic-citizen.html

So for your Finnish spouse, once he/she is registered with Skatteverket/Swedish Tax Agency (or perhaps at the same time while this registration is being processed) you (as a non-EU citizen) can apply for a residence permit based on your marriage. You can find information about this and the application form for this on this other Migrationsverket page: http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Nordic-citizen/Permits-for-family-members/Residence-card-in-accordance-with-EU-rules.html

If the children are Finnish citizens then it seems they need only register with Skatteverket, or if not (if they are non-EU citizens) then they can fill out the same application as you. The Migrationsverket website also says you can make your application for a residence permit once you’ve arrived in Sweden, and if you need a visa to travel to Sweden they will also grant you this.

Those Migrationsverket links should give you a good start for the whole process. Good luck!

    Reply
    1. Administrator Post author

      Hello Sami,

Yes, Sweden has set a precedent for processing your claim as a refugee/subsidiary protection and allowing you to remain in Sweden, even if you gave your fingerprints to another EU country.

Even though this goes against the Dublin Regulation, which says your refugee claim must be processed in the first EU country in which you arrive, Sweden has been processing asylum/refugee/subsidiary protection applications made by Syrians, Iraqis, and Afghanis who have arrived in Sweden via another EU country.

Furthermore, the Dublin Regulation also has a provision that if you have ties to an EU country, for reasons such as having a family member there (this is your case), then it allows that EU country to process your claim even if it is not the first EU country you arrive to.

Anyway, this is my understanding of how it is currently working in Sweden. I would say apply with Migrationsverket now because it seems as more time passes the less receptive the government will be to more refugee applicants. Here is a website with links to some resources that might be helpful:

Hello Cherry Elauria, congratulations on your upcoming wedding. It sounds like your boyfriend is a Swedish citizen. The Swedish Migration Agency (Migrationsverket) has a page that explains how you can prepare to move to live with your future husband in Sweden (this link is for you if you are already married by the time you want to move to Sweden): http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse.html

If you already have a residence permit based on your marriage to a Swedish citizen then I don’t think you need to do anything special to get into grad school.

As for documents, you will need to show that you have health insurance and I believe that is it. Of course, you also need to have your official marriage certificate, and you may need to get it translated (I know they also accept marriage certificates in English).

I would recommend reading around the web to see what else you can find- I wasn’t in your situation of going to school or marrying a Swedish person, so perhaps there’s something I’m missing. But as far as I know you just need to fill out the applications and follow what’s written on that Migrationsverket link. Have fun

Thank you so much for all that you are doing for so many people!! I read through as many of the above questions as I could but would like to ask specifically to my case as well 🙂

My boyfriend (Swedish) and I (American) submitted an online application for my Residence Permit Card on Dec 06, 2015. Before any decisions are made, I understand that the Swedish Migration Agency must first invite me to book an appointment for an interview, photographs and fingerprints at an embassy in the US. I understand that 70% of the applicants take up to 14 months when it’s all said and done. The answer I can’t seem to find however is : Am I able to travel to and/or stay in Sweden for up to three months (as I do not require a Visa) while we wait for our pending application to be approved? If so, what is the best way to go about this without affecting our wait-time or eligibility? Once we receive our approval letter, am I able to pick-up the Residence Permit Card at the Swedish Migration Agency upon arriving back in Sweden?

I am from India I applied new residence permit application in January 2015, so its been 13 months waiting for their answer. From 2012 June I was living in sweden and I started working in the same year, I broke up with my (Ex)girlfriend, then I stayed in sweden because of job. But in 2014 they deported me that time I was in a new relationship still we are in relationship. I thought may be I can retain my permit because of my job, unfortunately they closed my previous case I took my ticket back home to India went to swedish embessy in new delhi then I found I got a ban for one year because I stayed 2 week extra than my residence permit. Me and my girl friend apealed against the desition both time they rejected with NO. Then they redirected us to apply new application ie registered on January 2015. I am done with my interview from embessy in july. Nothing happened after that, I do have a personal number and skaverket id kort(card) valid until 2017. I am hoping a positive result from them , so if they grand me permit will I get the same personal number? I am so tired contacting immigration board. I am getting so frustrated staying so long in this queue.

Hello, yes it sounds like you’re having a very frustrating time. I believe the personal number is based on your unique identifying information (birthdate, sex, where you were born) so it would remain the same.
Hopefully you can stay patient and you get approved. It looks like at this point two years have gone by for your current relationship, so you could even apply for a residence permit based on a common-law marriage.

My new girlfriend is Swedish, because I over stayed I got a re-entry ban for an year, we appealed against the decision from India then both time they rejected my appeal, so we submitted a new application in December 2014. During my former stay I always worked for same employer too. Right now I am waiting for my new application that was registered on 24th January 2015, so soon it will be 13 months. So I am living in India from September 2014 till now waiting for their decision. My employer from Sweden still want to hire me, he said he can fix work permit. By law I am sure I am not allowed to have two applications at a time, is there anyway my boss can help me and speed up these process? We haven’t got any case officer yet it seems, I never anticipated this long queue. To be honest my whole stay in Sweden was a tragic, my girl friend says there is nothing else we can do than waiting, I am scared what if they will say no. She visited me twice during this period, I can see that 70% application need processing time of 14months. We are not even married or registered spouse. She asked immigration whether it will help us to speed up the process if we get married, but they said that will not help. We have no idea what to do, do you have any advice for us? I appreciate time and effort.

    Thank you!

      Hello Nikhil,
That sounds like a frustrating situation, and I’m afraid I don’t know of any way to speed up the process. You could try and get your outstanding application cancelled, then have your employer arrange to sponsor you for a work permit- I would imagine the total time waiting for that would be shorter than waiting for an application to go through to join a future spouse (I’m assuming you applied via this route). However since you are already waiting over 13 months for this latter application, you might as well hold out for a decision. The real question is, how long does a work permit take to process, and unfortunately I don’t know the answer to this.

Hopefully you will receive a positive decision on your current outstanding application soon.

      Best of luck

well i just read your case and because i know some informations maybe can help a little so i decide to write some lines here
first i will not recomend you transfer your application to a application for a work permit because its very tough and got 10 times requieremnts than a family renufication
there is diferent rules that apply to hire someone from outside sweden wich is divided in 2 groupes eu citezens and no eu citezens for a swedish employer befaure he is elegible to hire some one from outside eu he must first had posted the offer to arbetsförmedling for some time then when he doesn t have any candidate he must go through eures i mean european citizen than he can apply for someone outside europe it look like that job must be something very specific and they don t have competency to cover it

    Hello Administrator.

I want to know how can asylum seeker in Sweden get a resident permit base on family ties. An asylum seeker living together with his girlfriend and they were planning to get married.. If it’s possible, how will he go by the process tnx.

Hello Cecii, I think you would need to cancel the asylum application and then apply from your home country to move to a future spouse in Sweden. However waiting for this to go through currently takes at least around 14 months.

      Good luck

Hello Joshua, I believe you can move with your wife to Sweden whenever you want. All you need is to meet the health insurance and income requirements, and they take her income into consideration when you are applying.

Hello! I’m about to have an interview in Swedish Mission (in Vietnam) I’m so nervous. My fiance is Swedish, living in Sweden. We’ve been trying to get me resident permit for 2 years now, so i can move there and we can get married. We were denied. And now I’ve got an appointment again. Last time, they asked me to give them reason why they’d trust me, that our love and engagement is real. I dont remember what i said, but we got denied. Its so frustrating. I dont know whats more convincing than the truth. What should i answer those question? I’m not so good at “feeling” and “emotion” talk. Any tips plz? Thk u in advancce!

      Hello Aliano Fann,

Sorry to hear you were denied, that sounds frustrating. Do you have any pictures with you both together, and pictures of you together with each others’ families. Also you could provide phone bills or chat logs that show you specifically talk with each other for many many hours. Those things could help.

I’m not sure what they look for to demonstrate a marriage is “fake” in Sweden, but if it is similar to what they look for in the USA then it would be: different race, different religion, different language, different age.

I’ve heard that it can even just depend on who interviews you- it could be someone sympathetic or someone skeptical. All you can do is try again and provide all the documentation you have that your relationship is real.

Good luck and hopefully it works the second time.

I do not want to go back to India I did apply Asylum in Denmark but they have Rejected my asylum application!! Can I applied for a resident permit for Sweden based on my wife she’s a swedish citizen!!
I do not want to go to India and apply i want to move from Denmark to Sweden from the prison is it posible?

        Hello John,
I believe as long as your residence permit for Denmark is valid, then you could stay in Sweden. I don’t know of any official legal way that you could move from Denmark to Sweden because of a residence permit based on either being married to a Swedish citizen, or moving to Sweden to marry a Swedish citizen- for both of these options, officially you need to apply from your home country and wait a considerable amount of time for your application to be approved and your residence permit to be prepared.

        Best of luck

      Hello Galil Olsen,
The decision is entirely up to migrationsverket- I believe all you can do is wait, and be ready to present them any evidence that your marriage is “real” is they ask for it- for example, pictures of you together, with your families, shared purchases, chat logs, phone bills, etc

      Hello John,
Normally Migrationsverket says you must apply for a residence permit to move to a spouse in Sweden from your home country, and wait there until the residence permit is ready for you. However, Migrationsverket says it might make an exception if your spouse in Sweden is pregnant:

      http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse/If-you-are-in-Sweden.html

To apply this way you need to fill out Form 161011, Assurance of Cohabitation, and Residence Permit for a Child to Settle in Sweden (you can find all these through the link above), and send these to the Migrationsverket office in Umeå.

      Best of luck

Well-written post. Very informative. My predicament is that I have just gone for an interview at the Swedish embassy, however, my wife has just discovered that she’d been emailed to provide more information to MV about two weeks ago (about the same time I was contacted to book an interview appointment). The message went into her junk instead of inbox. She only just saw it yesterday and hurriedly tried to complete the form but it seems to have timed out. My questions are: Is there any penalty for the lateness? Does this in any way affect our application? And if so, how? She is going to call them today to sort it out. any information helps. Thanks

    Hello Admin,

I am a british citizen living in Sweden since November 2015. I have received my Personal number ID card late december and registered our marriage certificate in sweden. My wife is an non eu citizen, I have just come back from a long 7 weeks holiday to visit my wife in her home country.
She has applied for a visa to visit sweden on tourist, which we are hoping she will be given one in a couple of weeks time.
My sister in law (my wife’s sister) has her own company in sweden and is the person who will be covering the cost of her stay when she arrives.
I have read your situation and I think I am in a similar situation as your wife being an eu citizen living in sweden.
I just want to be sure if my wife arrives here on tourist, can she apply for a resident card and even if the wait for a reply can be longer than her 90days visa stay? What happens then?
Correct me if I am wrong but I believe I need to have 3 months wage slips in the last three months if she is applying for a resident card?
I am waiting for my work contract which I should receive soon, is there any minimum wage requirement?

I hope you can help me out here, we really want to start our lives together as soon as possible. We are both in our twenties and have been married since August 2015.

    Thanks in advance!

Hello Andrew- congratulations on your recent marriage. Yes, I believe your wife can apply for a residence permit once she arrives in Sweden on a tourist visa (because you aren’t Swedish- for Swedish citizens it’s different). Also I believe it’s fine if the processing time exceeds her tourist visa, as long as she applies before her tourist visa expires.

As for the financial requirements- I believe your wife needs to meet the maintenance requirement (https://www.migrationsverket.se/info/4442_en.html). When I got my residence permit my wife and I had just moved to Sweden and neither of us had jobs or much savings, however my wife had a scholarship to study there (~7,300 SEK/month- the minimum required amount at that time) and that was enough for me to qualify for a residence permit.

      Have fun

Thank you so much for your quick response! Much appreciated.
Before moving to Sweden, I had planned to work at my sister in law (wife sister) company. When I applied for my personal ID card, I gave in my employment offer aplication which allowed me to get my personal id card. I’ve been training and helping out at my sister company since my arrival while waiting for my personal id card last late december.
I was hoping to bring my wife over as a non eu spouse but also very worried looking at the processing time up to 8months and also even longer if need so.
Being 3months apart was already hard hence I booked a long holiday nearly 2months in january as my sister in law (boss) saw how sad we were apart from eachother.
I planned to get my work contract sorted shortly after receiving my id card but already booked my flight back to my wife host country. Decided to wait when i got back, and ended doing more research about bringing non eu spouse to sweden. I ended up here which im very glad ! Giving me more hope!

My wife is currently waiting for a visa, she has been told today that she will soon receive a decision through the post by the embassy from her host country.
I and my wife also don’t have many savings like you did, we have approx 3000 euros savings too.
How many months your wife had to prove income was coming in her bank when you applied for an resident card? Do you think providing 2months of my bank statement will be enough for a decision for her to get a resident card while she is on tourist here ?

My salary will be 8000 a month in the bank as Im starting at the bottom job role as a cashier which is not much.

Hope to hear from you soon pal.
        Thank you !!

Yes, hopefully your wife can join you much sooner in Sweden then you initially thought.

My wife’s proof of her scholarship was simply a piece of paper with the university stamp on it that said she would get around 7500 SEK per month for a total of eight months. And based on this I got a residence card valid for five years.

I think if you can show that you are employed and make 8000 SEK per month then you should be fine. Hopefully 2 months will be enough.

        Good luck

      Hello there again

You pieces of advice really helps lots of people..,
I personally I am really stressed on how some embassies treat applicants.
I am Kenyan and I have read a few Kenyans here who are always rejected entry like myself.
I was rejected visa last year,I got married to the Swedish man and I applied for a residence permit..my husband called the immigration to ask if it’s possible to get visa for a month and they said yes but my residential permit case will be stopped for sometime.
I applied for a visa therefore but unfortunately they denied me entry reasons I may not leave the schengen area after expiry of the period….this is crazy!!!!!!

        Hello,

Sounds like a very frustrating situation. As far as I know, if you are married to a Swedish citizen then you have the right to eventually get a residence permit and move to Sweden to be with your partner.

If you have followed all the steps on this page (https://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse/How-to-apply.html), and you’re not sure why they denied you, or you think they shouldn’t have denied you, then I would recommend sending an email to Migrationsverket to ask for clarification, and what you can do to qualify. If you think you meet all the requirements and they still say no, then perhaps you should speak with a lawyer.

Sorry but I’m not sure what else to say. Maybe someone reading will have a better idea. Good luck

my question i don t know how they will handle our case i can t find any in the migrationsverket

Hello Sam, I’m not sure about your situation because you are applying as a long-term resident of the EU, however as I understand, as a long-term resident of an EU country, in the eyes of Migrationsverket you are basically considered as being an EU citizen who is not from Sweden.

I believe for non-Swedish EU citizens, they can bring their non-EU married partner or common-law partner (living together for at least two years) to Sweden immediately, and that partner can apply for a residence permit within Sweden. The only obstacle for this is if your partner needs a visa to travel to Sweden, but the processing time for this is relatively quick.

If you have never lived together and aren’t married then I think you will have trouble getting a residence permit for your partner via this route or via family reunification.

Good for your situation that you have an apartment and stable income.

I’m also not sure how all this will work as your transfer your permanent residence status to Sweden, and ultimately because your situation sounds less common I think you will need to talk with Migrationsverket more about it anyway to have a good outcome.

      Best of luck

first thank you so much for your reply its very very kind from you that you had created this platform so the people can share them experinces worry and have some help from each other
As i said and you too my case its not really comon and clear first of all when i went to ask how to apply for family renufication they gived me a form 136011 wich is different to others and i had requested to be apply on her behalf here in sweden at the end i did but the main problem is the huge difference between each case officer it look like they have differnet ways some say you could some no the second thing when i went to apply they said you can t you have to fill those paper and her too and send it via post wich i did so since that time my case been traveling all over sweden from sundsval till malmö then till värjo and i am living in göteborg i asked why it been done this way and why not göteborg unit and why all this transfer from one unit to other i didn t get any answer like many others i had made i don t know if it just for me or is it a comon practice ??
i am also in very delicate situation because some risk that my partner she is facing from one psycopath there ,a man with lots lots power that neither me or her can face and when i had wrote emails and make calls trying to move things faster didn t get any feed back and instead one of the officer i ve been talking said maybe your case will be handled by some UNHR wich also confused me because it look like he understood that i am applying for asylum to someone i know than i am applying for family renufication but facing a dificult circumstances

      2. Administrator Post author

        Hello again,
I’m not sure what else I can tell you that would be useful for you. If your partner is just now applying for a visa to move to a future spouse (you) in Sweden then I believe she must do this from her home country and wait many months for the application to be processed. Perhaps because she is in a difficult situation Migrationsverket would consider this and allow her to apply from within Sweden, however you must speak with Migrationsverket about this.

As I understand, the quickest way she could come join you immediately is if you got married- you could even get married in a third country and then take the marriage certificate to Sweden. However I would also recommend first confirming with Migrationsverket that this would work, because of your situation of being a long-term EU resident who is a non-EU citizen. However I don’t know if this option is possible due to your/her own circumstances.

These are the only routes I can think of that you can take. Perhaps someone else reading will have better ideas, and perhaps Migrationsverket could also provide some other additional solutions.

Hopefully you will find an answer and best wishes

      Hello Adham,

I’m not sure who told you to hide for 18 months, however I suspect it wasn’t Migrationsverket?

If your appeal was rejected then you will have a very difficult time getting any kind of legal status in Sweden- perhaps you could try another country?

I’m not sure about the “stateless” status- perhaps it gives you more options for what to do in Sweden. If you really want to stay in Sweden then I would recommend talking with someone or an organization that can tell you all of your options. Hey!

A Non-Eu citizen with a permanent residence permit in Sweden with an Albanian citizen. Applied and have been waiting for 16 months even though our application is integrated as they say in migrationsverket and we never made anything against the laws of the migration agency, and my partner has been waiting in Albania since December (As she visited me in Sweden for a couple of months)

Anyone knows how the hell does that “migrationsverket” work?
How can a couple be apart for 16 months just waiting for their decision to live together?
Anyone knows how long should we wait more? And how is it fair that some people get their decisions within 7 months while others need to wait for a couple of years?! Pfff !!

Though I’ve been asked to answer three or four questions a couple of months ago. And I got no answer or contact after.

    Thanks for the answers previously.

    Hi Admin,
Thank you for the great work you are doing. I stumbled on your page and must say your responses are impressive.

I am not an EU citizen and here is my situation:
    1. Husband got a postdoctoral job here pending his defense.
    2. Prior to this he was due for his defense in another EU country still in march and we applied for a visa to attend.

    3. While preparing for his defense, he applied for a resident permit for both of us and received notification that we could both go to the embassy for our finger prints and photographs. Since this came while he was in the EU country for his defense, he changed the appointment address to Sweden and we both moved here to have our finger prints and photographs. This was about a week ago and we were told the resident card will be out within 7-10 days.

    4. I am already 36 weeks pregnant and need to at least book an appointment with a midwife but I hear this cannot be possible without a personnumber. We are now stuck because the resident card will not permit me access care until the swedish tax authority issues the number. What are my options? Can I get some form of maternity care while waiting? Who do I need to talk to? I don’t have health insurance coverage but my husband earns at least 25000kr per month. Hope yo hear from you soon.

I would like to be in Sweden with my boyfriend the whole time of my pregnancy. Is there a way that i can stay any longer than 90days? I am a non-Eu citizen and I dont need visa for visiting Sweden.

Congratulations on your upcoming baby. Migrationsverket says on its website that if you are pregnant you MIGHT be able to remain in Sweden while your residence permit application is processed. I would talk with them about changing your status to allow you to stay while the application is processed.

The section about being pregnant and applying within Sweden is detailed here: http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse/If-you-are-in-Sweden.html

I have a very important question.
I have a temporary residence permit and if the relationship ended after six months or after one year. Does the Swedish partner have the right to claim that the relationship is ended up and ask for canceling the card? How could granted a permanent permit if a relationship ended before 2years

        Hello Lila,

I believe Migrationsverket will notify you if your permit is revoked because the relationship it was based on ended- this is possible. When you apply for a permanent residence permit (after five years) you will need to show that you are still in the relationship.

        Good luck

      Hello Lily,

Unfortunately I don’t have any experience with your situation, but hopefully someone else reading does and can provide you with a relevant answer.

Have you tried contacting a local clinic or hospital? Perhaps they could also provide you with helpful information. I believe you must have health insurance before you can apply for a residence permit, so perhaps you can purchase health insurance (including foreign plans) that is accepted by a healthcare provider there. This could also be a temporary solution for seeing a midwife.

The information I have found about getting into the Swedish healthcare system is detailed in this comment: https://openbordersimmigration.com/how-to-get-a-residence-card-through-marriagepartnership-uppehallskort-through-marriage/#comment-110

Thank you admin. I got the resident card on the April 8th although it was lying at the migration office since April 1st. I applied for the person number same day April 8th and told my case worker that I was pregnant and needed to at least see a midwife as a matter of emergency . Received it in the mail on April 14th and typing right now in a gynaecological clinic while waiting for a midwife. So happy!

    hello…
im from indonesia and i have a boyfriend, he is swedish citizen. we are gonna get married next year in August. I saw that it takes 14-16 months to get a decision for a residence permit. so when should i apply for it via online?

      Hello Aling,
Congratulations on the upcoming marriage. According to Migrationsverket, if you (a non-EU citizen) are planning to move to Sweden to get married to a Swedish citizen then you should fill out the application as you mentioned online and wait for it to be approved. However, going to Sweden as a tourist and then getting married is not addressed, and I’m not sure if you could stay in Sweden via this route. So I’m not sure what to advise for this latter option, which would obviously be more convenient for you.

Feel free to post back on how your situation turns out, whichever route you choose. Good luck

hi, my swedish partner wants to move to me to Germany and live with me for a few months so my question is, will i be able to follow her to sweden after that period and apply for a residence permit from inside sweden ? I am able to support her both financially and non financially since she is only a high school student. I am a non EU citizen living in Germany

      Hello Omid,

First, if your partner is under 18 years old I’m not sure about the laws for her moving to Germany and registering her residence there. I know for adults, if they plan to stay in Germany for a while (it depends on the state- from 14 days to 90 days) then they are supposed to register their residence with their local rathaus. However for tourists (less than 90 days) I believe this requirement does not apply.

As a Swedish citizen, she has the right to stay in Germany on her own, so she doesn’t need to mention anything about you (again, I’m not sure how age affects this).

You going to Sweden could depend on your status in Germany. If you are a permanent resident then I believe you are basically considered to be an EU citizen and you can move to Sweden as such, independent of your partner.

If you have a temporary German residence permit (say, valid for five years), then I think you can live in Sweden for the extent of its validity, though you might have trouble getting into the Swedish “system” (for example, I don’t think you could work or get into the healthcare system).

Otherwise, as a non-EU citizen who is in a relationship with a Swedish citizen, you can’t apply for a residence permit simply on this basis.

If you are married to your partner then you can apply to move to Sweden on this basis. If you live together for at least two years then you can apply on a common-law partnership/marriage (sambo) basis. If you plan to get married in Sweden then you can apply for a Swedish residence card on this basis, though you will have to wait until your application is approved (right now around at least 14 months).

If you got married in Germany or another country then I believe you would still need to wait outside of Sweden until your application for a residence permit was approved.

Again, all these scenarios are for someone who is an adult, I’m not sure how they apply to someone under 18.

Hope this answers your question, and good luck.

Greetings, I am a Croatian married to a Filipina, we married in Croatia, she has a Croatian 5 year temporary Residence Card, currently we are living in Sweden together with my wifes sister and my wifes sisters husband, they are both Swedish citizens and employed. What should we do in order to obtain personnummers and get right of residence before my wifes 3 month Schengen visa expires, I am currently unemployed, I applied in Arbetsförmedlingen for coordination number, they told me to wait 2-3 weeks, Skatteverket should call me on the phone they said. Can my wifes sister and my wifes sisters husband register us as supported/dependant family members, how would that work. We came to Sweden a week ago, I am looking to get employed, but it isn’t guaranteed that I will find work in these 3 months. Basically, the question is, what would in your opinion be the best thing to do as a backup so we don’t have to go back to Croatia for 3 months if I am still unemployed after the 3 months have expired. Thank you so much in advance.

Greetings Filip, from what I understand, if you and your wife have savings to support yourselves (~10,800 SEK/month for a married couple) then your wife could get a residence card and you could keep looking for a job for that period of time. If you don’t have savings then I’m not sure what you can do once the three months expire.

One possibility you could do if you cannot find something better, is to apply for your wife to get a residence card (even if you think it will be denied on the grounds that you don’t have enough to support yourselves) and I believe she can stay in Sweden while the application is being processed. Perhaps that extra time would be enough to find a job.

Of course the best is if you find a job soon and then your wife can apply for a residence card and you can both apply for peronnummers.

I’m not sure about dependent family members- maybe you could find a better solution via that route.

Best of luck and hope you find something soon

Thank you so much for your helpful reply, I have another follow up question.

I have found a job in Sweden after one month of being here, 19th of May was my first day, the contract is not permanent, and it is hourly pay, how am I to obtain a personnummer if I can not prove that I will stay for 1 year minimum through my employment? I still have the coordination number, the job pays over double the minimum 10800 SEK a month after tax for supporting 2 people, however my pay check on the 25th of June will be for only for those 9 days that I have worked this month, then on July it will be for the whole of June.

The problem is that in order for my non-EU wife to be able to stay and get the residence permit, I need the personnummer like they told me in Migrationsverket, and then just the copy of passports, marriage certificate and employment certificate.

Is there a way for my wife to be able to stay even if I don’t have a 1 year minimum contract?

        Thank you for your reply.

      2. Administrator Post author

Hello again Filip- congratulations on finding a job.

It sounds like you’ll still be facing the time limit for your wife to apply for a residence permit before the 90 days run out. In this case I would apply for a residence card for her, even if you don’t have a permanent contract. Just submit your temporary contract and bank savings. Perhaps she would get a residence card for six months, and then again in that time you can find something permanent and reapply. Perhaps they would give her a residence card for five years anyway. And even if she doesn’t get a residence card I believe you could appeal the decision if you have a permanent job by the time Migrationsveret processes the application- which will likely take a few months.

Otherwise she will overstay her visa and then that could possibly cause problems in the future.

Anyway, that is just what I would do, perhaps you (or someone else reading) can think of a better course of action.

Also, when I got my five-year residence card my wife only had a “job” (it was a school scholarship but still enough to qualify) guaranteed for eight months. And she never had a personnummer. It seemed the personnummer was only if she wanted to work, but otherwise because she was an EU citizen (and as a student had healthcare) I (a non-EU citizen) could get the residence permit based on her EU nationality. I will say also that this was a few years ago, so perhaps Migrationsverket has changed its policies. If it is like you say that you need the personnummer for yourself for your wife to apply for a residence permit, then I would say basically the same thing- apply for that with what you have (and perhaps your wife can apply for her residence permit at the same time? Maybe that is being too optimistic about the application system).

Sorry that I can’t provide you with exact information, but hopefully this will help.

        Hope it works out well

My name is Johanna and I love with my fiance in Indonesia who is an Indonesian citizen. We are planning to get married in September and we want to live mainly in Indonesia as we have a business here but at times want to be in Sweden as I can manage or business online.

Now I have a few questions,

Can be have a temporary residency for Sweden so we can move freely between our countries?

In the case that this is not possible,
In case of emergency ie death or sickness in my family and I have to go home straight away would he have to apply for a visitors via and wait 2 weeks for it to be processed before he can join me?

    Appreciate all the help.

    Kind regards

Hello, congratulations on your marriage and coming baby.

If I am understanding correctly: you both have permanent residence in an EU/Schengen country and you want to move to Sweden to be with your spouse. I think in this case you can move to Sweden anytime you want.

Here is some information you might find helpful, especially the part about people from Norway:

      Hello Zin,

If you’ve read the website then I can’t tell you anything new than what is in the section: “Coming to Sweden/Travel While Residence Permit Application is Being Processed.”

I know it is really ridiculous that you are supposed to stay apart for many months from your spouse while you wait.

Personally I don’t think I would have that patience in your situation. Before the whole migrant/refugee situation was such a big issue, you could fly into Denmark and then cross into Sweden and they weren’t checking the border- they would never know you were there (you would just fly back from Denmark before your Schengen visa expired).

Now though I think they are checking the borders. However, if it was just a visual inspection of your passport and visa (they didn’t scan it at the Swedish border) then I don’t think you would get into the system. The question is- is it a visual check or do they scan your passport. I don’t know. I recently crossed the border into Germany and they just did a visual check.

      Good luck!

Hello…i have a question regarding residance permit. I am non-EU and my husband is EU citizen who has been living and working in Sweden for almost 2years. I came here as a tourist, in a meantime we got married and i applied for residence card in migrations. Now, three months time allowed to me as a tourist expires very soon and i wont get the card by then. So… Am I obliged to leave Sweden or I am allowed to stay here longer than 3 months due to my pending immigration application?

    Thank you ,

      Hello Maria,

I’m not eacctly sure about your question due to your circumstances (getting married to a EU non-Swede citizen while on a tourist visa) being slightly different than mine (non-EU citizen married to a non-Swede EU citizen in a third country before moving to Sweden).

However I would suspect similar rules apply in both our cases- for me I believe I could stay in Sweden past my 90-day time limit because I submitted an application for a residence permit before this time came.

I would still say double check with Migrationsverket. Maybe your spouse can understand enough Swedish to read the law about that? Or at least call up Migrationsverket.

      Good luck

    Hi,
I’m a citizen of Republic of Georgia which is not in EU Union.
I’m 22 years old Gay girl, I have a girlfriend also citizen of Georgia, we are together for almost 5 years. Here in our country we have terrible conditions of living, we have to hide ourselves being gay not even speaking of being together. It is so dangerous to be open gay here that it can be dangerous for our lives.
We’ve always loved Sweden and always wanted to end up there, but we don’t know how to make it happen.
My question is- is there a way for us to come there with our own resources and to get citizenship there with the gay status?

I’ve heard it’s possible, but before abandoning everything here, jobs and everything, and coming there I would like to know what chances do we have. AND what should we do when we arrive in Sweden in order to get citizenship ?

      Hello Eli Melmon,

Yes, you might have a more enjoyable time in Sweden. It sounds like you can qualify to live in Sweden on several bases: working, studying, and perhaps asylum (I’m assuming neither of you has Swedish family or any other familial connection to Sweden). Once you or your partner qualifies to live in Sweden, the other person can also apply for a residence permit.

To find more information just look through the pages on this website. Employment (https://openbordersimmigration.com/immigrating/immigrating-to-sweden/work-permit-in-sweden-how-to-get-a-swedish-work-permit/), asylum (https://openbordersimmigration.com/how-to-get-refugee-asylum-in-sweden/), student (get admitted to a Swedish college or university).

For now I would say focus on getting a residence permit- you can think about citizenship later (I believe that you have to first live in Sweden for some years, perhaps at least five years, before you can apply for citizenship). For each of these routes your path involves one of these: finding an employer, proving that you can qualify for asylum, or getting admitted to a school.

You can consider which path you or your partner has the most chance for.

Also, if you have enough savings you can always travel to Sweden as a tourist and perhaps meet sympathetic people who can give you additional ideas. Maybe someone else reading can offer you more ideas too.

      Good luck and stay persistent

Does that mean, that one of us has to get residence permit first separately and take the partner later ? I know what you are saying about qualifications, but can we both like arrive in Sweden and get married and try to get residence permit together?

      2. Administrator Post author

Ya, I believe if you can qualify through any of those paths then you can both apply together at the same time. If just one of you qualified (such as if one person was a student or just one person had a job) then I think the other person could also apply if you were married (and apply from within Sweden). Also another factor- have you lived together for the past three years? If yes, then you could apply for a residence permit as common-law spouses without the need for marriage.

Of course, all of this is assuming at least one of you has a path to a residence permit- likely job or school (I suspect it would be hard to prove asylum unless you had strong evidence).

Another note- you are supposed to apply for a work permit (and I believe a residence permit based on being a student) before you come to Sweden. So that would mean you both stay in Georgia until one of you gets a residence permit to Sweden. Then you get married (anywhere you can/want-and if you have been living together for three years you potentially don’t even need to get married), and then you can both go to Sweden and whoever doesn’t have a residence permit can apply from within Sweden.

Hopefully that answers your question? And hopefully you can get it worked out quickly and easily.

We are thinking about asking for asylum in Sweden, together because we can’t leave each other. we are living together for 4 years and a half already. do you think the situation in our country is enough reason to get asylum in Sweden?

      4. Administrator Post author

I’m not sure how your case would go, but you can always try. The general conditions for asylum are here: https://openbordersimmigration.com/how-to-get-refugee-asylum-in-sweden/

Here is an article from Migrationsverket that addresses the issue directly: http://www.migrationsverket.se/download/18.5e83388f141c129ba6312b8b/1381926424262/HBT_en.pdf

Hi, i m a non eu citizen married to a finnish woman for more than 2 years and we lived together all this time in finland. I applied for a residence permit and it was refused first from the immigration service then from the court. I make appeal to the supreme Court, and i need to wait another year for the decision. so we’re thinking to move to sweden and apply for a residence permit there. can someone tell me please if we can move before the decision of the court? And if there’s some similar case like mine? Thank you.

    1. Administrator Post author

Hello Karim- first let me clarify: your current case for a residence card is pending in Finland, and you haven’t made any applications in Sweden.

If this is the case, then you can go with your spouse to Sweden and apply for a residence card once you arrive (perhaps you need a visa to travel to Sweden? Then you will have to get this). Read through the requirements on this page to see what you will have to meet to qualify for the Swedish residence card through marriage (health insurance, savings or income, etc).

I don’t think Finland’s decision in your case would have any bearing in Sweden.

If you are talking about a decision to be reached by Sweden’s supreme court then I’m not sure, but I would guess you would need to wait. Perhaps someone else reading could comment on that, or you can always ask Migrationsverket or a lawyer.

Here is someone who was in a similar situation: https://openbordersimmigration.com/how-to-get-a-residence-card-through-marriagepartnership-uppehallskort-through-marriage/#comment-334

I am a non eu citizen, have uppehållskort and have been living in Sweden since 2013 with my husband who is an eu citizen. I got uppehållskort based on our marriage. He is a PhD student in Sweden and I have been employed in Sweden since 2014, permanently employed since January 2016. We travel abroad regularly, both together and separately and several times when travelling on my own I was told at airport passport control when entering Sweden that I am not allowed to travel outside of Sweden without my husbands company. After being told this I was let enter Sweden anyway. This sounds very illogical as I’m not under age and I obviously cannot expect my husband to follow me on conferences or business trips.

My question: is it true that uppehållskort limits my possibility of travelling abroad on my own?

If so, should I change my uppehållskort to another kind if residence permit that would be less limiting?

Being a citizen of Serbia I have a right of up to 3 months visa free stay in Sweden anyway, uppehållskort makes it possible for me to live with my husband and work here, it seems very illogical that with these circumstances I can be denied of entering Sweden.

    Best regards

      Hello Tamara Pavlovic,

I’ve never heard of any such law or requirement, speaking as an immigration law amateur. I just did a search on the internet and also didn’t come up with any regulations such as this. It sounds like that person at the airport passport control needs to be retrained. It’s a pity you didn’t get their name so you can write a letter about it.

As I understand, as long as you have your valid Swedish residence card you can come and go from Sweden as you please, and you don’t need an escort from your husband (it sounds like Saudi Arabia).

Perhaps there might be some kind of regulation that you need to live in Sweden for six months out of every year to renew your residence permit.

      Best regards

      Greetings Alex,

You can fill out a short questionnaire to get an estimate on your waiting time through this Migrationsverket webpage: http://www.migrationsverket.se/English/Contact-us/Time-to-a-decision.html

I tried it for your situation according to what you have said, and it estimated your waiting time to be 15-19 months.

If Migrationsverket didn’t ask you or your wife for additional information then I would think they are still processing your application as normal. It sounds like a good sign that they took your biometric information too. If you are worried they have the wrong address for you or if you have any other questions then you can always write them an email or call.

Hopefully the residence permit will arrive soon.

My first question is that should I marry in Sweden or other EU like Denmark as i think to get married in Denmark is easy.
Secondly when I register my marriage with Sweden tax.. after that how many months late can I apply for residence permit.
Thirdly after applying for residence permit do I have to go back Pakistan to wait for a decision or i will be granted visa to stay in Sweden after my Austrian student residence expire.

        Greetings Ali Ahmad,

Congratulations on your upcoming marriage. To answer your first point- I’m not sure if there are extra burdens for applying for a Swedish residence permit if you also get married in Sweden. There may not be. We are in a similar situation though, and in my experience (as a non-EU citizen marrying a non-Swede EU citizen) I found it easy enough to get a Swedish residence card after marrying in a third country (which for you sounds like Denmark).

For your second and third points: when I applied for a residence permit I did this through Migrationsverket (Skattverket- the tax agency- was for a personnummer, though that may have changed since 2012) after I was already in Sweden as a tourist.

I believe I needed to apply before my tourist status expired, and in your case I think that means before your student visa expires. I applied and remained in Sweden throughout the entire process (it is the permanent Swedish residents and Swedish citizens who have to wait a long time for their spouses abroad to receive their residence permits).

Additionally, because your future wife is Norwegian she will have the “Nordic citizen” status which also has advantages: http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Nordic-citizen.html

All this being said, you still have to meet the income and health insurance requirements.

        Good luck

I believe as long as you apply for your residence permit before your student visa expires then you will be okay, and you can remain in Sweden the entire time until you receive a decision from Migrationsverket.

I also believe if you are applying for a Swedish residence permit then your spouse must be registered as living in Sweden.

For me to get a residence card I didn’t need to register my marriage with the tax agency (Skatteverket- that was for a personnummer). When I applied for the residence card with Migrationsverket I submitted a copy of the marriage certificate with my application and it took about two or three months till I got the residence card- but that was a few years ago, now I suspect it would be longer.

is that she was already registered with Skatteverket?

      Hello,
No, she did not have the personnummer, and actually never applied for one with Skatteverket. No, I didn’t receive a temporary visa, just a letter saying that my application was being processed. So during that time while it was being processed it felt like a gray area, but I would assume you’re allowed to stay while it’s being processed (it’s like that in the US and in Germany at least, I just haven’t done the specific research to resolve this question).

    hello,
In the upper text you have written that
” I applied for and obtained a residence permit as a non-EU citizen married to an EU citizen who registered her right to reside in Sweden.”
it means that she was registered to Skatteverket with personnummer.

but now you have written to me that
“No, she did not have the personnummer, and actually never applied for one with Skatteverket.”

please can you clear me that .
see on 15 June I am going to marry her in Denmark. After getting my marriage certificate. What should I do next with sweden to get residence permit.

    Bundle of Thanks!

Ah, I see how that is confusing. She “registered her right to reside” through Migrationsverket. Here is a post that has more details: https://openbordersimmigration.com/how-to-get-a-residence-card-through-marriagepartnership-uppehallskort-through-marriage/#comment-56

Naturally once you read that you will again be confused because in fact there it says the EU citizen must register with Skatteverket.

Unfortunately I can’t resolve this confusion, I can only write the details about what worked in my case. The hope is that people can use my case as information that helps them to make the best decision for their case. Like piecing together a puzzle, however it could be a much more complete puzzle if more people would write what has worked for them.

Since your case is similar to mine but not identical, I’m afraid I won’t have all the information you’re looking for, plus over time some procedures will change. Feel free to ask more questions though, I’ll tell you what has worked for me.

    Brother,
I asked from Skatteverket they say that your wife has to obtain a personnummer by getting registered by Skatteverket office. They said she just have to register and get number that all. After that you can apply for residence permit to migrationsverket.

I have checked on the migrationsverket website that new rule is going to be implement by 20 july. So I want to finish all the process before that, Bro, I am getting married on 15 June after getting marriage certificate I still have one month left. But I am worried that if all the paper work will be done on time . They have also told me that after applying for my residence permit I can not go out from Sweden until the decision take place.
Now what do you say hopefully can I get with all papers and apply my residence in one month.

    Thanks bro,

    hello,
I am also in same situation. i got different answer from every different person.
My wife is Norwegian passport holder she is living in Norway from last 15 years. she says that if the rule is changing for Asylum seekers of course it will also make some change in other laws.

what I came to know from asking too many people is (EU citizen married to non EU citizen) :
First you have to get marry and wedding in Denmark is easier than Sweden.
than you have to register your weeding with Skatteverket. you must have a proper house to get register with Skatteverket to get personnummer. And must have sufficient funds available approx 11000 per month. Than your non EU partner can apply for residence permit with valid visa. After applying for residence permit one has to wait for his/her application decision.
till the decision he/she (non EU citizen) is not allowed to move out from Sweden.

If you can enhance my knowledge, please go a head.
    Thanks!

      Greetings Saduni,

You can apply for asylum in Sweden if you have reason to fear persecution in your home country, and sexual orientation is one of the specific circumstances addressed by Migrationsverket.

I will direct anyone with a similar question to this page, where you can find the information about how to apply:

Hei, Skatteverket is quite slow on summer time. But, I had a similar situation as you do. And what you can do until she gets her Personnummer is to fill the Migration form and attach your marriage certificate (translated to English), a copy of her passport, a copy of her working contract and a copy of your passport (just identification pages and the one with the stamp). Send it to Migration, once you did your application you are not illegal anymore, even the tourist visa expires. There is a Law in Europe that says that once we marry a european we already have the right to be here. But of course formalities must be taken. According to the same law, the government can take in maximum 6 months to grant the residence permit. So, better not travel while you wait for the card.
Migration did not send me any confirmation letter, or any protocol code – which was pretty annoying. But, call their centre and tell your information, they will tell you with whom in is and give you the phone to the person responsible for that. So, after a week you can call the person just to get in touch. The decision is made by two people.
In my case we already had my husband Personnummer and his Swedish ID when we did my application on November, and it took around 15 days until I received the letter granting me the residence permit, and two more days to receive the card home.
Unfortunately on summer time things go pretty slow, and Personnummer took more than 8 weeks for my husband. For me, in late November it took less than I week until I received my number.

      Greetings Beshoy,

I don’t think it’s guaranteed that you get a personnummer- you still need to meet the income and medical insurance requirements (as for timing, I think as long as you apply at the same time or after her you should be okay). I’m not sure how long it takes to get a personnummer, but I believe that as long as you apply for your residence permit before your tourism visa expires then you will be okay. You just shouldn’t leave Sweden until a decision is reached for your residence permit.

      Good luck

Can i ask you a question, hopefully you can help me.
i am a filipina and i am separated in philippines (still married with filipino but we are separated)
i am 6months living now in sweden and my visa is residence visa i coming here with my boyfriend swedish guy.
In sweden if you want to separate a marrage couple they called it a “devorce” and in philippines we have “annulment”.its almost same “devorce” but it takes a couple of 3-to 5 years to finalize the decision in philippines. My question is?
-Can i do apply a devorce here in sweden so it will be quickly that i am already devorce.? If i can what should i do.?
    – I am a residence here but my personbevis is still “gift”(married).?
-Its possible to apply permanent visa even my annulment is still processing?
-What should i do to change that ?
-It’s their another rules or option for the immigration about that in a easy way?

Please help me what should i do! Thank you

      Greetings Rica,

I believe before you can get a residence permit based on marriage to a Swedish citizen you must show that you are not married in the Philippines. I’m not sure how the system in the Philippines is, but I think divorce is something that is recognized by the state/government, and an annulment is something that is recognized by the Catholic church. For Sweden I believe they need something that is issued by the Philippines government (state or local), and the Swedish government will not give any consideration to a document that is issued by a religious authority.

Applying for a divorce in the Philippines depends on the government policy there, I’m not sure if the Swedish government has any procedures you can take. Perhaps the Philippines will allow you to apply for a divorce from abroad? You need to check how to apply for a divorce in the Philippines.

I’m not sure what you mean about your residence permit being based on a gift. My understanding of the Swedish system is that you can only get a five-year residence permit based on being married to a Swedish/EU citizen if you are already married to that person.

You mentioned that your boyfriend is Swedish. My questions for you are: are you married to your Swedish boyfriend, where did you get married, and is this marriage recognized by/registered with the government where you got married? Have you registered your marriage with Skatteverket? How are you living legally in Sweden now? Are you on a tourist visa, or do you have a residence permit?

When you respond, can you also please clarify the terms “annulment” and “divorce.” In the Philippines is an annulment granted by the state or by the church? For Sweden, I believe you must have proof that your prior marriage has been dissolved by the state.

      Thanks

      Hello Mansuru Hashim,

Yes, I believe it may be possible for you to get a residence permit based on being in a common-law marriage (by the definition that you have lived together for over two years) already now based on your current circumstance. You may not even need to get married. Check with Migrationsverket about this. In the worst case you can get married in Sweden or anywhere else 😉

I’m not sure how long it will take for the UK to renegotiate all its treaties with Sweden now that they have voted to leave, but I think you have a matter of at least months.

      Have fun in Sweden

First of all, I’m not sure you could get a personnummer as a student- perhaps if you were getting a scholarship, but it sounds like this would be ending soon anyway.

For the marriage route- I believe the way it works is that you get married, apply for a personnummer, and then apply for a residence permit.

      Hello Selam,

Every country has its own regulations for getting married, so I can’t tell you where you can get married. However I suspect that in Sweden, the UK, and most other countries, the reason you are in that country is not considered. In other words, I suspect you can get married in Sweden or the UK, you just need to find out the procedural steps to take for this. Here is an article that talks about those for Sweden: http://www.huffingtonpost.com/2012/02/09/getting-married-in-sweden_n_1265800.html

Hello, I think if you are married then the UK will consider your status as being a non-EU citizen who is married to a UK citizen. Then you just need to follow the UK’s procedures for applying for a residence permit there.

        Congratulations on your upcoming marriage

Hello, I’m not sure which previous comment you’re referring to, but perhaps this will answer: in my experience once I received my decision (after about two months of waiting) I was then fingerprinted and had my picture taken. It then only took about a week to get the residence permit. If you are non-EU married to an EU citizen then you have the right to work, however this isn’t covered by the residence card. To work you need a personnummer, and for this you go through Skatteverket. For non-EU married to an EU citizen, I believe the current process is first you apply for a personnummer through skatteverket and then you apply for a residence permit.

      Hope this helps

      Hello,

As I understand they are asking to see that you have comprehensive health insurance that is valid in Sweden for at least one year going into the future. I believe this can be public or private insurance.

If you had health insurance in Austria as a student, and it is valid for at least one year going into the future, then this may fulfill Skatteverket’s A1 requirement, however there is some debate about this (https://www.reddit.com/r/TillSverige/comments/46y9rx/eu_citizen_here_why_do_i_need_to_have_a_year_of/).

Unfortunately I can’t provide you with much information, but hopefully someone else reading can fill in the gaps.

    -to get married in Sweden
-to get married in my country
-to try to get permit thru Sambo visa.

    Thanks in advance!

      Hello Nik,

Congratulations on your upcoming marriage. I’m not sure where the best place to get married is, but I think getting married instead of the Sambo could save you some time waiting for the Sambo application to be processed (at least several months).

As I understand, if you are planning to move to someone in Sweden to get married then you are officially supposed to go the Sambo way. If you go to Sweden as a tourist and get married while you are there then I think you are in a gray zone.

For me, I got married to a non-Swedish EU citizen in a non-EU country, then moved to Sweden with no problems or wait. However the process is different for a non-EU citizen marrying a Swedish citizen.

The best thing I can tell you is to have your Swedish girlfriend talk with someone at Skatteverket/Migrationsverket and ask what is the quickest way you can legally move to Sweden (residence permit and personnummer).

If you find out any useful information then feel free to post back about your experience- your question is one of the most popular unsolved questions on this website.

      Best of luck

      Hello,

Congratulations on your upcoming marriage. The first question is, is your future EU spouse a Swedish citizen? If she is then the way you are supposed to do it is to wait abroad until your application is processed.

If she is an EU citizen who is not Swedish then, as a married couple, I believe you can move to Sweden with no wait and you can apply for a residence permit while you (both) are in Sweden.

I’ll continue assuming she is an EU non-Swede.

First you need to research the requirements for getting married in Sweden (here is one discussion about that: https://openbordersimmigration.com/how-to-get-a-residence-card-through-marriagepartnership-uppehallskort-through-marriage/#comment-121).

I’m not positive, but I suspect your immigration status does not have an influence on getting married in Sweden.

Once you are married then I believe you can follow the process detailed on this webpage for a non-EU citizen getting married to an EU citizen who is not Swedish.

When you are completing this process I’m again not sure how your immigration status will affect your application, if at all. This is a common outstanding mystery for people who write on this page, so if you go through this process fell free to write back and tell how it unfolds.

In any case, this is the best course I can think to take. Maybe someone else can also contribute something.

      Best of luck

      Hello Dexxter,

That’s an interesting question. Time to consult the Aliens Act (http://www.government.se/contentassets/784b3d7be3a54a0185f284bbb2683055/aliens-act-2005_716.pdf)

From my amateur reading of “Chapter 3a Right of Residence for EEA Nationals and Others” it looks like you can only go to Sweden with your child if you were financially dependent on your child (assuming “descendant” means your child, and “ascendant” means your parents).

There could be more to it though, that is just my guess.

I want to know is you have ideas about the new law’s that the Migrationsverket about to apply to their system… About the Maintenance Requirement’s for Reunification.(Family ties).
Is it going to effect only families of those who has a permit base on protection (Asylum), Or is going to effect even the families of Swedish Citizen and EU citizen member’s all.. Tnx?

Hello Bab’s- it looks like this is what you’re referring to, and you can find the full answer to your question within this article: http://www.migrationsverket.se/English/About-the-Migration-Agency/News-archive/News-archive-2016/2016-07-01-The-Riksdag-the-Swedish-Parliament-has-decided-to-temporarily-restrict-the-possibility-of-being-granted-a-residence-permit-in-Sweden.html

It looks like the changes to the maintenance requirement will affect EU citizens. While previously EU citizens were exempt from the maintenance requirement, now they are not. If I understand it correctly, Swedish citizens must also meet the maintenance requirement if they marry a non-Swedish citizen for that person’s residence permit application to be approved.

Those are some big changes, I will have to update this website. Thanks for the question

Hello, here is a link you may find helpful, “Residence cards in accordance with EU rules for family members of Nordic citizens” (http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Nordic-citizen/Permits-for-family-members/Residence-card-in-accordance-with-EU-rules.html).

It says that as the spouse of a Nordic citizen you have the right to a residence permit and to immediately start working.

However, in reality from what I’ve found, employers are not going to hire you unless you have a personnummer. If I were you I would ask at Skatteverket what conditions you must meet to get a personnummer. Or ask for a personnummer application and see what is written there. Also make sure to tell them that you are married to a Nordic citizen.

At least you should be able to meet the requirements for a residence permit based on being married to a Nordic citizen (here is the application link from the website linked to above: http://www.migrationsverket.se/download/18.5e83388f141c129ba6312e57/1465482159424/bluk_145011_en.pdf)

Here is a link about traveling outside Sweden with a residence permit and then returning later: http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Travelling-from-Sweden.html

This is what Migrationsverket told me when I ask the the same question.. but on their website it doesn’t stand like that?

The new temporary law affects people who wish to apply to move to a family member in Sweden who has received a permit based on asylum. If the person in Sweden has a permanent residence permit, a temporary residence permit with refugee status or a temporary residence permit with subsidiary protection status and applied for asylum before 24 November 2015, then the family ( husband, wife, cohabiting partner or registered partner and children under the age of 18) have the possibility of moving to the person in Sweden. Both you and your partner must be at least 21 years of age.

    Hello, Administrator.
First of all I want to thank you for your great effort in answering and helping everyone. It is amazing!
My situation i like that: I am an EU-citizen, finishing my master studies and summer internship here in Sweden. My boyfriend (fiancé, already :)) is a non-EU citizen (Moldova) and we would like to move and live together here in Sweden. He has enough financial resources to be able to support himself (for at least 1 year). I already have my swedish personla number (personnummer) and plan to search for a job.
I have found different options for non-EU citizens to get resident permits, however they do not apply for my case:
    1. http://www.migrationsverket.se/English/Private-individuals/EU-citizens-and-long-term-residents/Work-study-or-live-in-Sweden-for-EU-citizens/Residence-cards-for-family-who-are-non-EU-citizens.html – for this one, we are not married yet
    2. http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Planning-to-marry-or-become-the-common-law-spouse.html – for this one I do comply with the maitenance requirements (I dont have a permanent job)

Is it possible for my fiancé to get a resident permit, until I obtain a permanent job or until we get oficially married?
And if yes, what the procedure should look like?

Thank in advance for your reply!

      Hello Mihaela Lozovanu,

Congratulations on your upcoming marriage and apologies that your comment was initially blocked (it does that automatically if you include more than one link).

Unless you have been living together for at least two years I don’t know of any way how he can get a residence permit based on his relation to you while you are not married, except of course for the second option you linked to above: residence permit based on moving to someone to marry.

However this option can take months (and quite possibly over one year) to process. Probably the quickest way he could get a residence card would be if you got married.

      Best wishes for you both

    Hi,
I thank to administration of this website. And I hope you all are fine.
    I have a question ,
As I am (non EU) married to a Norwegian. I applied for residence card and provided them with residence card application and marriage certificate. I asked them to take the prove that how my wife will support me (pay slip and account statement) but they refuse to take because they said that its not important but on the residence card application it is written that my wife have to give the prove of supporting me financially.
Same is when my wife went to skatteverket to get the personal number they also said that we don’t require your job contract pay lips etc .
I am a bit confused because its written on both websites that to get personal number and for residence card application she needs to show her source of income.
    waiting for answer.
    Thanks!

      Hello,

I suspect it’s because your wife is Norwegian (Nordic citizen), and as the spouse of a Nordic citizen you can have an easier time getting a residence permit/personnummer:

        Hello everybody!
I hope i can receive your responses for my case.
        – If I come to Sweden with tourist visa (non Eu visa) and register married certificate, after that getting married with Swedish guy. So Can I apply for residence card in Sweden (no need to go back my home country)?
        – And if they allow me as a non-Eu citizens to registered married in Sweden?
        – Which documents will they require for such a registeration?
        – And during time of application, if I get pregnant, is there any influence to the result of my case?

        Thanks so much!

Hi there, i have just go through all the comments. Feel so relaxed. bt i want to know something.
I am from Pakistan. My husband is in Sweden. he is doing job there. We recently got married in Pakistan then he has gone back to Sweden after few days. On April 11th 2016, he applied for my visa via online application. After that i received an email from ‘migrationsverket’ stating that they have registered my application. And then on May 31st i went to Islamabad Sweden Embassy for biometric.
They took my fingerprints and pictures. Now i am on a waiting mode. Please let me know how long it will take to be processed my case?
Really its so hard to live without a partner.
Migrationsverket has not contact me for further information yet. Please tell me about the waiting time.
    Thank you.

      Hello,

Yes the waiting time is very frustrating and can take a while these days. You probably know about these sites:

      Waiting time calculator (http://www.migrationsverket.se/English/Contact-us/Time-to-a-decision.html)

      Check your application online: (http://www.migrationsverket.se/English/Contact-us/Check-your-application/Without-login.html)

Are you waiting for your residence permit to be processed? There is a new regulation that allows you to visit Sweden while you are waiting: http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Nyheter/2016-06-09-Possible-to-travel-to-Sweden-while-you-are-waiting-for-your-decision-for-a-residence-permit.html

However if you are waiting for a visa to travel to Sweden then I can’t offer you any more links. If they took your biometric information then hopefully you can receive permission to go soon. You can always email/call them to make sure they have your correct contact information too.

In my case my biometric pictures weren’t processed correctly and I needed to get them re-taken. The trouble was they didn’t tell me this so I waited for a month before contacting them to ask what was going on.

Hopefully you get everything straightened out soon

Hello Muneeba- I’m surprised they didn’t send any other information that would give you a more definite answer. I can’t say what they meant based on what you have quoted. If they didn’t include information about appealing, when you must leave, etc then I would agree with Raheel

i am a non EU citizen from africa living in sweden (illegaly) under an expired visa, that ended over 10months ago. I am living with a swedish man and now i am 6 month pregnant. we are trying to look for every option for me to stay here in sweden legally without me going back to my country. I can for several reasons not go back to my country due to my family has rejected me for changing religion, living with a non african man and for being pregnant without telling them.
In order for me to get permit to stay in sweden we have talked about several options such as marrying, applying as sambos or also by cause of the baby might be born in sweden and being a swedish citizen with one swedish parent. we have talked to the migration office and they say i have to apply from my home country, but i will have to stay there for many months in that case, and there is nowhere i can turn to anymore in my country.

so what should i apply for? marriage, sambo or for my child needing its mother. i can not bring the child with me back to africa living on the street.
also, how great is the posibility for me to get to stay in sweden while the investigation and paper work process with the migrations office will go on?
if i apply now while being pregnant, will they send me home before i get to give birth to my child?
Please help us with any advise.
    Thankyou.

      Hello Fabricia,

From what I’ve read there are some indications that you might be able to remain in Sweden while your application is processed. For the best advice I would recommend talking to a lawyer in Sweden who works with immigration.

Migrationsverket says you might be able to remain in Sweden while your application is being processed under conditions specified on this webpage: http://www.migrationsverket.se/English/Private-individuals/Moving-to-someone-in-Sweden/Spouse-registered-partner-or-common-law-spouse/If-you-are-in-Sweden.html

      Best of luck for you

This is my opinion only( do not get back to your country) get marry and apply within Sweden to get your PR and wait to see what they say. This way you have nothing to loose . Tell them you have no one in your country to support you or your baby and if you leave this may put you and
your babies life in risk. Your visa is expired ad they can not deport you specially when you are pregnant. If all options fails then request for refugee status.

Hi and thanks for the great effort you’re doing
    I have a question for a friend.
He has work permit in Sweden. This is his first year here and he bought a flat. He wants to start the process to bring his girlfriend to Sweden. She’s Ukrainian and when she went to the Swedish Embassy there, they told her that the process time will be faster if she is married to him.
The question here, She can come to Sweden with a tourist visa but can she get married to him in Sweden and he doesn’t has a permanent residence Visa. Just a work temporary Visa?
He prefer to register as a Sambo so they can get married at his homeland with all the family, would it be possible to register as a Sambo?

      Hello Salah,

As I understand a person’s immigration status doesn’t affect whether or not they can get married in Sweden. For example, I think two Japanese tourists could get married in Sweden while they are on vacation there, as long as they take the appropriate steps.

For the Sambo, I believe they must have been living together for at least two years.

      Hope that helps,

Hello my name is Eden….I have so many questions in my mind now pertaining of getting married in Sweden in connection to my future application for resident card and I am very thankful that I have found this site.
Like I have said I have so many questions in my mind right…by the 7th of this month I will be married via civil officiant to a Swedish guy, I am a citizen of non EU who is now in Sweden just for 90 days visa…
First Query, In our application for getting a marriage license at the tax office me and my partner put in there that I will be using his aftername (Surname) and the case is I will be leaving Sweden by the 22nd of this month because my 90 days end….Since I am already married before I leave Sweden will it be trouble for me to the Airport I mean will I may be hold because my return itinerary still in my maiden name along with my passport info?
Second, my passport has remaining validity of 19 months and as far as I know if I apply for resident card I must have more than 24 months left in it should I need to renew it and if I must can I change my name based on my husband’s surname? Is it okay to apply for a resident card if my passport has been changed to my husband Surname? (because I doubted that maybe I must have my maiden name then when I will apply online) What can my husband do so I will be having a personnummer even if I am still in my country.
Third Query, If I will apply for resident card is it enough that I will just enclosed my husband’s paper for his annual income? (with no income proof documents from me)

Hoping for your answer…. Any reply to this is indeed a great help for my clarifications.Thank you so much.

      Greetings Eden,

Sorry but I’m not sure about your first questions regarding your name change and passport renewal. Hopefully someone else will respond who has more specific information.

I would say do everything to apply for a personnummer while you are there (submit all forms, etc) and it will hopefully be processed while you are back in your home country. I believe if your husband makes enough to support you both then you don’t need to enclose any income for yourself.

Good luck, and congratulations on your recent marriage.

I said to them my husband don’t send money every month , I’m not financially dependent with my husband since I’ve been working for 7 years until now , I would like to know if this is one of the reason to be denied? Hoping for your inputs.

      Hello,

Your husband lives in Sweden, and you are applying for a residence permit to move there as a spouse?

If they are going to deny you for financial reasons I think it would be because the incomes of you and your husband combined do not meet the minimum requirement (I believe something like 9000 SEK for two).

      Good luck

      2. Administrator Post author

Hello SS- if you’re going to stay in Sweden you should go for a residence permit. If you get this then you don’t need a visa to stay in Sweden, but be careful to keep your visa status legal until you apply/get a residence permit.

I’m not sure about applying for multiple or different types of visas at the same time. Feel free to write back if you find any information about this topic because I’ve had the same question from several other people.

As far as I know you can get a residence permit if you are married to a Swedish citizen or if you’ve lived together for two years (common-law/Sambo partnership). Otherwise you’re supposed to apply from your home country for a residence card to move to someone in Sweden who you are going to marry.

So you are in a gray area. I would say talk to someone at Migrationsverket for advice on what to do. Hopefully someone else reading will give you more specific answers.

        Good luck

Hello, I could really use your help!

I am a Danish citizen currently in a relationship with a Brazilian girl.
We are both 21 years old.

My girlfriend is currently staying in Denmark as an au pair, she has a contract that lasts until late 2018.

We are planning to get married soon, and wanna know the possibilities of her getting a Swedish residence permit.

    Here’s my questions:

Should we be married in Denmark or Sweden?
Can we live in Sweden doing the process? (Since she loses her au pair)
What is the best way to go about this?
How big are the chances of her application getting approved?
Should we hire a lawyer while doing it?
Should we get married and then apply or apply and THEN get married?
And how long after marriage should we apply?

My biggest question as describes above:
HOW LIKELY ARE MY GIRLFRIEND TO GET APPROVED?
I really don’t wanna risk her going back to Brazil.

    Thanks!!!!!

Hello! By new rules of June, 2016, any Swedish citizen who wants reuniting with a family must to have the sufficient income. But I can’t find information about if the Swedish citizen is a student and does not have a job. Can his family to show a document from bank(from country where is family). Or it is okay only for students who are in Sweden according to the student’s visa and aren’t citizen’s of Sweden?

    Hi,

I am non-EU but my wife is EU citizen. We moved to Sweden and I got 5 years residence permit. We are married for 1,5 year and living in Sweden for 1 year. We don’t have kids.

In my case, if we decide to divorce, can I retain my residence permit? or after divorce will it be revoked? I would like to continue my life here in Sweden. I just started to work from 1 month.

    Thank you in advance.

Hi, well a question, since it is so difficult to get approved for a husband/wife non-eu residency to live with Swedish person. Are they allowed to stay together from day one in another eu country ? Because in Sweden the eu residents have that right in Sweden. And so why is it so difficult for the Swedish people?

Now we are married and living in non EU country and want to go to sweden and settle here and work together.

How can this work ? How can i get the residence if we are planning to move and settle there and work. Because we both are fresh graduates and she has a master s degree , in addition she’s swedish at birth.
How much time does the residence permit must take ?
Is it 100% guaranteed to take it ?
Can we go both there and instead of letting my girlfriend to wait there alone.

Hi I am looking for advice on the correct process to flow for my circumstances.

I am a brutish citizen but have been working overseas (outside eu/euass) since 2014 where I met my now Swedish wife in December 2014. We have been living together since 2015.

I have been staying on and off in Sweden since the summer of 2015 for long periods up to 3 months at a time.

We bought a house together in Sweden and got married this year in Sweden.

That’s were it gets confusing or I get confused about process of applying for residence and ultimately Swedish citizenship. We get different advice when we speak to Swedish authorities.

I understand getting married in Sweden causes an issue in terms of applying for a ID number and residence but not clear why. As an EU citizen I have been told I can only stay in Sweden for 3 months is this correct? If so do I just need to leave country every three months for one day or more?

Can you provide advice on what process I should follow to obtain:

    1. A Swedish personal ID number. Do I need medical insurance. I can prove I am financially self sufficient. Can you recommend a health insurance provider as none I find meet the comprehensive health insurance requirements.
    2. Right of residence. Should I apply via Swedish embassy in London? Using what form? In light of britex I think it is wise to do this soon.
    3. Citizenship. When do you apply for this. After two or three years?

      Hej
Im eu citizen living in sweden so i may know one think or two about those procedurals
U say u can provide yourself i can suppose even your wife can provide for u and that u have bought a house in sweden so i think its very easy for u to get moved in sweden and get the id card.u just have to go to skatteverket and apply for personal number.take with u your marriage certificate, prove that u can provide yourself and health insurance (its not so hard,u can find a thousand companies that provide that kind of service in the internet and u can purchase one very easy.my husband purchased one that it covered 10000€ for a period pf twelve month for a price of 150€)with those u go there and say i want to apply for personal number…here in sweden its a bit odd bcz u can speak with 10 ppl and ll get like 11 different answers so u go there and say i have read the law in your f***** website and im sure ull apply and ull get it cuz us the eu citizens we have a thing called the right of rezidence…so if we have money work study or any other inkomst we have”right of rezedence”and we can stay in sweden for as long as we want…now about the sweden citizenship i think u have a long way there getting it cuz i know it after 5 years of living sweden ….for any other question u can write to me at egi_kore@yahoo.com

I hope it works out for u

    Hello Admin,

I hope you can shed some light on our situation. I still had my student visa to Czech republic when I decided to take a break and be an auPair in Sweden. I was able to meet my family and stayed there for almost 3months. During this time, my host and I formed a relationship. We have not thought about it more carefully because we applied for an auPair visa so I can still stay in Sweden/EU until we figure things out if we really would want to commit and get married. It was a month before the expiration of my visa. As much I would’ve wanted to stay, my visa was almost near its end date and that lead me to go back to my home country. The decision has been received just recently that it was rejected. And in the course of time, both of us realized that we are committed to be together.

Now we are faced with a dilemma on what to do next. I, however, gave up on the idea to have the appeal since it will still take more time. Also, I am a bit afraid to take further steps again applying to the Migrationsverkket since they already have our record from our auPair application.

We have been thinking of several options on how should we go over the situation. But given that I am currently in limbo being unemployed and all my savings used up, it is quite a grim state since these are two of the major points to prepare should we consider applying for a tourist visa or visa to visit bf/fiance.

We also decided to get married but our biggest question is where given our situation now. Is it better to get married here in the Philippines and apply for the spouse visa? Or go there with a tourist visa then get married. We know that all options take time but we really hope we can lessen the waiting time.

This is quite a long one. Thank you so much for the patience, kind understanding and time.

    Hi Admin,

I’m from the Philippines married a to Swedish citizen. We met in Manila while he was an expat and married in Hongkong before he moved back to Sweden April 2017. We also lived together in Manila for more than 2 years prior to our wedding.

My husband had to move back to Sweden due to a good job offer, but he cannot take me with him immediately. So we applied for my PR visa May 2017, it took 8 months until the migration agency contacted me to have my interview and I had it January 2018.

After the interview we have to wait again, for their decision and its tiring because we dont know when they will contact us. We are legally married and I dont understand why the process need to be this hard? I have been trying to contact them via email and was asked to wait. Living away with my husband has been a challenge especially the 6-7 hour time difference. We married because we committed ourselves to each other and wants to spend the rest of our lives together.

Is there a way we can fast track the process? Given that we are legally married and that I already had my interview?

My fiancé and I want to marry. She is a Swedish citizen and she lives in Sweden and I’m an American citizen, living in America.
The delima is that she is still legally married and her estranged husband has refused to sign the divorce disillusionment documents.
He is verbally abusive to the children and wife.
She suffers from diabetes and he is causing much illness from the stress.
She has been living in this limbo for over 2 years, now. She has reached out to attorney and the social services but they are unhelpful.
Does anyone have a solution for this problem?

Hi just curious i am in sweden living with my fiance. We applied for a visitor’s permit to extend my stay. My fiance is a swedish citizen and i am filipina. If we get married in sweden, given that visitors visa is approved, does that entitle us to apply for a resident`s permit and wait for the decision here? Or would i need to go back to my country to apply for that permit.

    Hello Administration
I am a British citizen with a permanent residence permit in Sweden since 1986. I married a lady from Azerbajan last August (2018), here in Sweden. We have been living together since then. Our marriage is registered at the Tax Office and we are also registered as living together at the same address.
She has a valid 2 year work permit, that expires at the end of August 2019. Can she apply for an extended stay in Sweden as my wife after her work permit expires? Or will she have to return to Azerbajan and apply for a new residence permit to join me as her spouse in Sweden?
It seems silly to split us up, as she already has a personnummer, and we will have already lived together as a married couple for over one year in Sweden. She can also continue working at at her current place of employment, if she can extend her present 2 year work permit after it has expired.
Her daughter (19 years old) is also able to reside here on account of my wife’s working permit. So we are also wondering if she will be able to continue living with us, if my wife is granted an extension of stay, alternatively given the right to live in Sweden with her spouse.
Do you we think we should contact Migrationsverket and explain that we are now married and wish to apply for a residence permit for my wife, or would it be better to wait until her work permit expires in August?
Our hope is that she can remain here, and not have to return to Azerbajan to start a lengthy wait for a new application/permit to enable her to return and have the right to live with me and work in Sweden. The thought of being apart for as long as 24 months is heartbreaking.
I have the utmost of sympathy for anybody who is forced to wait for long periods of time to be together with their loved one’s. I only hope that Migrationsverket’s workload decreases so that the waiting time is more humane for those longing to be re-united with partners and family.

I just wanted to post this for anybody who is in the same situation I was.
Last year I married a lady from Azerbaijan. She already living here on a 2 year working visa. We did not know each other before she came to work in Sweden. We met here in Sweden, fell in love and got married here. I then applied to Migrationsverket for her to stay in Sweden as a non Eu Citizen living with an EU family member. I am British.
After only two months, we got a reply from Migrationsverket that she had been granted a 5 year uppehållskort. This even applied to her 19 year old daughter who was only allowed to live here because of her mother’s temporary work permit.
This of course is fantastic news for us all. We are overjoyed.
My point here is, it does not appear to be neccessary to have to leave Sweden, and return and wait in your own country to apply for a visa extention, if you get married in Sweden. This as far as I know, only applies if one partner has been living here permanently, and the other has a temporary work or residence permit.
I hope that my post can help somebody in a similar situation.

    Hi there

I have applied for a residence permit to that I can move to Sweden with my Swedish husband and Swedish son. We all live in Sydney, Australia. We have been married 25 years here in Australia.

The Migration Agency has asked that we satisfy the maintenance requirement. Our issue is the requirement to have a home before we move to Sweden (ie before we are granted the permit). We plan to move in May 2021. We applied November 2019.

How can we find an apartment now that is available in 7 months time? It’s an odd requirement when we are not currently in Sweden. I am not sure how to respond to their request. We are madly searching for apartments that may be available next year, but it’s pretty much impossible.

Also what happens if we do find an apartment, sign a lease, but then can’t move (because the permit is not granted for other reasons). We are stuck with a lease.

Are there any way around this housing requirement or what would you suggest!?

    THANKS
    Dani

Hello! I’m a Swedish citizen and my husband is Japanese. We have lived together for more than two years outside of Sweden and moved back to Sweden together. Since we don’t want to be apart we applied from within Sweden just like you did and the migration say that unless I’m dying or pregnant they won’t make an exception for my husband and they’ll give him a no. So we’re super worried for the decision, we’ve been waiting for 9 months now and I want to ask if you why they made an exception for you? Maybe we’ve got a chance is what I’m hoping. 😥

You keep mixing up the terms “residence card” and “residence permit” in your post. Don’t.

They’re based on different rules and have vastly different legal grounds. Use the right terminology.

My wife in Swedish and I am British we are both pensioners and have means to support our selves. We have been together for 23 years and have homes, children and grandchildren in both countries. For as many years we have travelled both for pleasure throughout the world and also back and forward between our Swedish and British homes. Due to Brixit I applied in December 2020 for Swedish residency and my wife for UK residency. My wife was given UK residency after a tumultuous campaign including going to the court of appeal I was refused residency ! Can’t be believed – Migrationsverket made so many mistakes- do did the courts. I have no where to turn, am on the edge of my 90days in 180 and attempting to reapply simply to get the application receipt so I can travel through the border. I have never been given a reason for my application being rejected. Much of what has happened to me contravenes EU Directives! “Facilitate Entry” you must be joking!

Feel free to contact me if you want more

I currently live in Sweden on a valid work permit (non-EU citizen) and my partner is a Swedish citizen. We have lived together in Sweden for three years. I am from a country that doesn’t require a visa to enter the Schengen Area for 90 days in the past 180 days.

The Migrationsverket website seems to indicate that I can apply for citizenship without having applied for permanent residency first. Is that true? Have you heard of someone who was able to do this successfully?

    Hi
I am currently working in Denmark with an unextendible visa that expires in a couple of days.
(I am non-EU) I am planning to get married to an EU member, currently living in Sweden (meets all the requirements).
We recently applied for a consideration of impediments to marriage in Denmark but they are taking too long so we decided to do the same at Skatteverket in Sweden.
We asked some people online and they said that applying to skatteverket is much faster and in the meantime I could apply for a EU residence card to be able to remain in Sweden with my fiancé.
Apparently, even if my Danish visa expires while I am in Sweden with my fiancé after applying for the EU residence card, I am allowed to be in Sweden until they make a decision to my case.
Note that we will make the application for the EU residence card even before receiving anything from skatteverket(therefore we won’t exactly be married yet). We will send in the marriage certificate after we are approved and get married
Is it possible that this is gonna work?
Will I be in Sweden illegally?

Any information about this will be very much appreciated.

      Hey,
If your fiancé is not a Swedish citizen but is currently residing in Sweden, and you can provide evidence of your genuine and ongoing relationship, you, as the non-EU partner, are entitled to the EU right of residence in Sweden. Therefore, irrespective of your Danish visa status, you would be permitted to stay in Sweden with your fiancé. Additionally, you would have the opportunity to apply for an EU residence card through the Migrationsverket. This card will serve as official documentation of your right to reside in Sweden under EU regulations, but your right of residence [if your fiance meets the conditions] does not depend on that.

Thank you so much for your reply, we will try doing that and hope that Migrationsverket will approve the EU residence card.

Thanks again and have a great day!

One last thing, Do you think we should wait until we get married to apply for the EU residence card at Migrationsverket?

I’m just worried that if we don’t get married before applying for EU residence card, I might be considered as overstaying my visa and hence illegally staying in Sweden.

Thank you! What would you say counts as evidence of your genuine and ongoing relationship – photos, travel tickets and such? Or is it a specific type of information that we would need to provide?

      4. Soren

It can depend on your case officer, but basically what you said. Photos dating back a couple of years which could be verified e.g. New Year’s eve pictures, family events like birthdays, travel tickets, etc. If you ever lived together at the same address at some point, utility bills could help also…

        Hi again Soren,

Thank you for your previous answers. This is a bit of a wild one, but do you think our previous application for a Sambo Tillstånd a year ago that was rejected because I didn’t live in Sweden long enough could be used as proof that we are a stable, long-term non-married couple as defined by the EU law?

      6. Soren

        Hey,
Anything that proves that you were and are in fact in a relationship helps, e.g. phone records, messages, pictures. If you applied for Sambo in Sweden earlier, then they probably have the record, so no need to mention that. Print and fill the application with different pictures and a bit of note explaining the occasion. Print your message history (time stamped) dating as far back as you have, phone records if you can pull it… You need to show that it is not a fictitious arrangement to acquire residency. That’s the goal.
        Hope it helps you guys.

Question I have been living with my wife who is a Swedish citizen in the UK for 10 years now, 7 of them married (married registered in Sweden and the UK). We have a 4 year old daughter (dual national) at some point I would imagine my wife would want to move back to Sweden, would we need to be living in Sweden for me to apply for citizenship?
